In March 2025 a probation officer went to The Observer and blew the whistle on a quiet scheme running inside the Ministry of Justice @MoJGovUK. Recalled prisoners, people sent back to jail for breaching their release conditions, were being freed again early. No Parole Board check. No judge. Just a caseworker inside HMPPS @hmpps signing them out the door.
The whistleblower said there were no exceptions.
Terror offenders, sexual offenders, domestic abusers, stalkers, even people under active investigation for new crimes could qualify, as long as nobody had officially rated them high risk yet.
He said staff were being pressured to change their professional judgment and wave people through anyway.
Over 1,000 inmates were being considered.
Around 400 more offenders could be walking around at any given moment once the scheme ran at full speed.
The Prison Officers Association @POAUnion, led by Mark Fairhurst @POAnatchair, warned jails were heading for another capacity meltdown. The Public Accounts Committee @CommonsPAC called prisons alarmingly full and said the government's own expansion programme was five years late and 4.2 billion pounds over budget.
Fast forward to 2026. The Sentencing Act 2026 became law in January. Recalled prisoners are now set to be automatically re-released after just 56 days in custody, rolled out nationwide this autumn.
What was once a quietly run pilot that a whistleblower had to leak to a newspaper is now written into legislation with a press release attached.
Almost 40,000 people were released early between September 2024 and June 2025 under the wider scheme. Recalls hit over 11,000 in a single quarter, nearly double what they were two years earlier.
The MoJ says this is about safely managing offenders in the community.
The probation officer who first raised the alarm said: some of these people cannot be safely managed anywhere.
