PEAK SOUTH CAROLINA GASLIGHTING A citizen files a FOIA for the tracking data on their own damn license plate, data the city already collected, stored, and can search at will through its Automated License Plate Reader (ALPR) system, and the city’s lawyers slam the door with a straight face.
Their excuses?
➡️S.C. Code Ann. § 30-4-40(a)(3): the records are “compiled for law enforcement purposes” and disclosure might “harm a prospective law enforcement action,” “reveal investigative techniques,” or “interfere with law enforcement operations.”
Oh, and suddenly they’re the champions of privacy. Releasing the historical location information on your vehicle would create “a detailed record of a person’s movements, associations, and activities” that undermines the Fourth Amendment and Article I, Section 10 of the South Carolina Constitution.
Let that sink in.
The same government that quietly blanketed public roads with ALPR cameras (Flock Safety systems in many SC cities and counties, feeding into SLED’s statewide database that has held hundreds of millions of plate reads for up to three years, accessible to thousands of users across dozens of agencies) now claims that letting you see what they already know about you would be the real privacy violation.
They admit the compilation of your movements is sensitive enough to implicate constitutional privacy interests… but only when you ask for it.
When they collect it without a warrant, without individualized suspicion, and without any meaningful legislative authorization or oversight, it’s just “public roadway” data and good policing.
➡️This is the classic surveillance-state two-step:
Weaponize “privacy” and “operational security” to keep the subjects from looking at the logs.
South Carolina has no comprehensive ALPR statute with real limits on retention, purpose, or sharing. Cities and SLED just did it.
Contracts get signed by police chiefs (see Greenville’s early deals under Chief Kenneth C. Miller), cameras go up (sometimes without even SCDOT permits), data flows to out-of-state servers and federal partners, and when a resident wants the records of their own car, the city’s legal team cites the very constitutional protections the system is eroding.
The denial letter is not protecting privacy. It is protecting the opacity of a mass location-tracking apparatus that treats every driver in the state as a permanent person of interest.
If the data is so sensitive that a citizen cannot see their own plate history, then the city had no business building the searchable database in the first place.
