Waqf की फाइलें खुल रही हैं और कई दिलचस्प कहानियाँ बाहर आ रही हैं। देहरादून की FRI कॉलोनी, कॉन्वेंट रोड की यह मजार सालों से वक्फ़ रिकॉर्ड में दर्ज थी। मतलब कागज़ों में इसे इस्लामिक संपत्ति माना जा रहा था। लेकिन जब भारत सरकार ने उम्मीद पोर्टल पर दस्तावेज़ माँगे, तो मजार प्रबंधन के पास मालिकाना हक़ साबित करने के लिए कोई कागज़ ही नहीं निकला। निकले भी कैसे?

ज़मीन वन विभाग की सरकारी भूमि है। जिन सैय्यद जमाल शाह के नाम पर यह मजार चल रही है, उनका या उनके परिवार का इस ज़मीन से कभी कोई कानूनी रिश्ता नहीं रहा। ऐसी लाखों मजारें फ़्रेंचायजी बिजनेस के रूप में काम कर रही हैं। मसूरी की बुल्लेशाह मजार भी उसी बिजनेस का हिस्सा है।

सवाल सिर्फ एक मजार का नहीं है। वक्फ़ की ऐसी सैकड़ों संपत्तियाँ सामने आ रही हैं जो दशकों से रिकॉर्ड में चढ़ी हुई थीं, लेकिन अब दस्तावेज़ माँगे जा रहे हैं तो कागज़ गायब हैं।

यानी जो ज़मीनें अब तक "वक्फ़ संपत्ति" और "इस्लामिक भूमि" बताई जाती थीं, उनमें से कई का आधार सिर्फ दावा था, दस्तावेज़ नहीं। अब खबर है कि जिला प्रशासन इस मामले में नोटिस की कार्रवाई करने जा रहा है।

इस मजार तक पहुँचने के लिए FRI कॉलोनी के भीतर कई अनौपचारिक रास्ते वर्षों से इस्तेमाल किए जाते रहे हैं। गुरुवार को यहाँ भारी भीड़ जुटती है। बाहर कॉन्वेंट रोड पर चादर, अगरबत्ती, प्रसाद और अन्य धार्मिक सामग्री का कारोबार चलता है। वहीं खादिम परिवार ताबीज़, झाड़-फूँक और विभिन्न प्रकार के अंधविश्वास आधारित कर्मकांडों के माध्यम से अच्छा-खासा आर्थिक तंत्र भी संचालित करता है।

विडंबना यह है कि इन गतिविधियों का सबसे बड़ा ग्राहक वर्ग अक्सर हिंदू समाज का ही होता है। जबकि इस्लामिक मान्यता के अनुसार सजदा केवल अल्लाह के सामने किया जाता है, किसी मजार या दरगाह के सामने नहीं।

अब सबसे महत्वपूर्ण प्रश्न यही है, यदि यह भूमि सरकारी है, यदि मालिकाना दस्तावेज़ मौजूद नहीं हैं, और यदि वक्फ़ में दर्ज करने का आधार स्पष्ट नहीं है, तो आखिर दशकों तक इसे वक्फ़ संपत्ति के रूप में कैसे दर्ज रखा गया? @pushkardhami
