Some thoughts on the Craig Wright saga, having followed it ever since my then-client Hodlonaut got served with the demand letter that started it all.
As Craig Wright gets hauled over the coals in the High Court today, it bears mentioning that CSW's legal strategy was, as far as I can tell, totally insane.
It was insane the entire time and what is happening today is the logical conclusion of that insanity.
If a client of mine had asked me to bring a campaign of cases like this I would have fired the client rather than perform the work. I have fired clients for less.
The entire thing seemed to be about conferring legitimacy on BSV. The defamation cases followed the pattern you might see from a reputation management team trying to squash rumors of an affair or something like that - fundamentally defensive maneuvers designed to crush a speaker and then move on.
Wright OTOH was using defamation actions to assert his identity when that identity was highly disputed. English law lets you do this, but that doesn't mean that you should. The strategy itself suffers from the Streisand Effect; the more you press a defamation action without actually producing evidence you are who you say you are (the easiest, cheapest possible way to win), the more you draw attention to that failure, which in turn makes reasonable people conclude you're only bringing the action in England solely because the structure of English defamation law lets you get away with it.
Similarly, the COPA case originated in an effort to get a declaration that he and his assignees - an English company - owned the Bitcoin code. I presume this was eventually with a view to compelling the Bitcoin devs to fork it for him and hand him coins, as demanded in the related Tulip Trading Limited case. This is an offensive rather than defensive use of copyright law.
In each case, if you haven't got the goods to back up your claims in a disclosure exercise, such litigation is extremely hazardous, verging on suicidal. Picking on one or two defendants that's one thing. CSW's mistake was going after the Bitcoin devs, putting his identity at the center of the case in an action where proving that identity was an element he had to prove (rather than a defamation case where the BOP is the other way round) and pissing off Square.
CSW's lawyers did other weird shit along the way, too. On prior occasions I have been very surprised to find that Wright and nChain had run around central London conflicting out a bunch of bigger firms. This is a passive-aggressive tactic you usually see with spouses in divorce cases. Lawyers take note: when you get a bete noire like this darkening your door, don't take the call. The billables aren't worth it.
tl;dr though this all started because Wright is a clown and English defamation law is a hot mess and a menace to freedom of speech all over the world. Wright was taken down only through the application of vast sums of money and many hundreds of years' worth of human time. This kind of waste is something the law should exist to prevent.
It didn't need to happen this way. Parliament should reform English defamation law by putting in reasonable burden-shifting to prevent this kind of fiasco from happening again.

I thought I could handle it because I've spent weeks in courtrooms that had Craig in them. But it turns out it's not the overtly evil people that get me – it's the indifferent ones, the unprincipled opportunists. It's Galloway rambling about media trends to promote himself to an audience of Craig cultists. It's the company executive who told me he believes Craig is a scammer but that BSV is just a blockchain he can profit from by taking direction from "the BSV people" (BSV Association). It's seeing all the people quietly working within Calvin's machinery.
