ATUALIZAÇÃO PÚBLICA DE DIREITOS HUMANOS: Esta atualização reflete a situação atual do advogado turco Emre ÇINAR a partir de 1o de janeiro de 2026.

A URA recorda o apelo público da Anistia Sul África @AmnestySARO de que as autoridades devem conceder ao Sr. Emre ÇINAR acesso confidencial ao seu advogado e família e que nenhum indivíduo deve ser transferido para um país onde enfrente um risco real de graves violações dos direitos humanos, incluindo detenção ilegal ou arbitrária.

De acordo com as últimas informações recebidas, a família e os representantes legais do Sr. Çınar, desde sua detenção em 30 de dezembro de 2025, aproximadamente às 15:00, nem sua família nem seus advogados receberam acesso presencial ou confidencial a ele.

A partir de hoje, nenhum acesso presencial direto ao advogado foi permitido.

Além disso, com base nas mesmas informações, a família e os representantes legais não foram formalmente informados se:

O Sr. Çınar compareceu perante um juiz; qualquer decisão judicial autorizando sua detenção, prisão ou extradição foi emitida; os fundamentos legais e factuais do suposto pedido de extradição foram divulgados.

Embora os procedimentos investigativos possam envolver um grau de confidencialidade, a base legal da detenção e o direito de acesso confidencial a um advogado e família não podem permanecer legalmente sem ser divulgados ou restritos.

Na ausência dessas salvaguardas, o direito à defesa é efetivamente prejudicado e o risco de detenção arbitrária ou por incomunicação é aumentado.

Em 31 de dezembro de 2025, o Serviço Nacional de Investigação Criminal de Moçambique (SERNIC) confirmou publicamente que o Sr. Emre Çınar, um cidadão turco, está sob custódia desde 30 de dezembro de 2025, supostamente em conexão com um pedido de extradição da República da Turquia, e que se espera que ele seja levado perante um juiz de investigação criminal. No entanto, persistem preocupações sérias e contínuas com o devido processo.

A Associação de Direitos Universais, portanto, pede respeitosamente às autoridades moçambicanas que garantam:

Acesso imediato, confidencial e desimpedido ao advogado e membros da família para o Sr. Çınar;

Divulgação formal de quaisquer decisões judiciais relativas à sua detenção ou qualquer processo de extradição; e

Cumprimento estrito do princípio da não repulsão e das garantias do devido processo ao abrigo da Constituição de Moçambique e da lei internacional de direitos humanos aplicável, incluindo a proibição de detenção arbitrária e incomunicável.

Até que essas salvaguardas sejam implementadas de forma clara e verificável, a URA continua seriamente preocupada com o risco de detenção arbitrária, transferência ilegal e negação de direitos processuais fundamentais.

UPDATE: Case of Turkish Lawyer Emre ÇINAR — Status as of 1 January 2026

@URASAFRICA issues this update concerning the situation of Turkish lawyer Mr. Emre ÇINAR, reflecting information available as of 1 January 2026.

URA recalls the public call by Amnesty International Southern Africa (@AmnestySARO) urging the authorities to grant Mr. ÇINAR confidential access to his lawyer and family, and reiterating that no individual should be transferred to a country where they face a real risk of serious human rights violations, including unlawful or arbitrary detention.

According to the latest information received, since Mr. ÇINAR’s detention on 30 December 2025 at approximately 15:00, neither his family nor his legal representatives have been granted face-to-face or confidential access to him.
As of today, no direct, in-person access to legal counsel has been permitted.

🚨 CURRENT STATUS
Since his detention on 30 December 2025, lawyer Emre Çınar has been denied confidential, in-person access to his lawyer and family.
There has been no official confirmation that he has appeared before a judge, no disclosed judicial decision, and no transparency regarding any alleged extradition request.
This situation undermines the right to defence and heightens the risk of arbitrary detention and unlawful transfer.

The Emre Çınar case is a test for Mozambique’s legal system, and also for the President @daniel_chapo24 and the government.

I want to keep my hope that Mozambican authorities will act in full compliance with international law.

International law is clear: if Emre Çınar is transferred, this may constitute a violation of international law due to the risk of torture.
Such a violation would engage responsibility not only for Türkiye, but also for Mozambican authorities.

There is no statute of limitations for crimes against humanity.

We hear that a plane from Turkey has landed in Mozambique.
If Emre Çınar is taken without a clear court process, this is abduction, not justice.

International law is clear:
• ICCPR Article 9 – no arbitrary or secret detention
• ICCPR Article 7 – no torture or ill-treatment
• Convention Against Torture Article 3 – no sending anyone to a place where they risk torture

Mozambique must not become part of this abuse.
