BREAKING: Special Counsel Jack Smith takes the gloves off and goes after shady MAGA Judge Aileen Cannon, ripping into her for her "fundamentally flawed" understanding of the case and orders that have "no basis in law or fact."

But it gets even better...

In his strongest words to date, Smith wrote in court filings that Cannon — who was appointed by Trump when he was president — doesn't appear to understand the classified documents case.

Smith and his team criticized Cannon's absurd request for them to prepare jury instructions that take into consideration Trump's false claim that he had the authority to take the classified documents. They have said that they will seek assistance from an appeals court if Cannon reifies Trump's baseless claims.

Last month, Cannon made the highly unusual request that attorneys prepare two versions of possible jury instructions, including the aforementioned one which would assume that Trump had total authority to take any documents he wanted from the White House.

"Both scenarios rest on an unstated and fundamentally flawed legal premise — namely, that the Presidential Records Act and in particular its distinction between ‘personal’ and ‘Presidential’ records, determines whether a former President is ‘authorized,’ under the Espionage Act, to possess highly classified documents and store them in an unsecure facility," wrote Smith's team.

Smith stated that Cannon is pursuing a "fundamentally flawed legal premise" because the PRA does not override Section 793 of the Espionage Act that Trump is accused of violating.

"That legal premise is wrong, and a jury instruction for Section 793 that reflects that premise would distort the trial," wrote Smith wrote, adding that The Presidential Records Act "should not play any role at trial at all."

Crucially, the prosecutors pointed out that the PRA doesn't apply in any case, because Trump took the documents AFTER he left the presidency.

The fact that Judge Cannon has not yet been replaced in this case is an insult to our judicial system. She was appointed by Trump, this is the definition of a conflict of interest.

Here are some basic facts:

Joe Biden didn't just beat trump in 2020.
He DESTROYED him. By 7 million votes.
He told him to shut up, and took his job.

trump had sent Rudy Giuliani all over the planet looking for dirt on him, and he even got impeached because he was so terrified of Joe, he tried to extort President Zelensky.

He spent all year saying he was going to lose to the guy he branded as "Sleepy Joe," while at the same time telling his supporters not to vote early and not to use mail-in ballots.

All this, while losing millions of jobs, more jobs than any President since Herbert Hoover, and telling people a deadly pandemic would "just go away" before suggesting bleach might be good.

He couldn't even denounce white supremacist groups on national TV.
"Stand back and stand by." Wow, OK.

So surprise, his stupid ass LOST.

And then, he was the WORST loser ever.
He lost 60+ court cases trying to un-lose.
Even his own appointed judges told him to beat it.

So what did he do? Invited people to an insurrection.
"Will be wild," he tweeted. January 6th.

They brought zip ties, a gallows for his VP Mike Pence, and hatred.
They chanted "Hang Mike Pence," and he watched for 187 minutes, doing nothing to quell the violence, telling Kevin McCarthy “I guess they're more upset about the election than you are.”

He spent a year saying the election would be stolen.
He primed them for that resentment.
And then he pointed that rage at the US Capitol.

After that trump was impeached AGAIN, and President Biden went about the work of saving America.
He and Democrats passed bills that put America back to work: he regained all of the jobs that trump's incompetence lost, and then added MILLIONS more on top of that, totaling over 14 million.

He lowered the cost of insulin, ensuring it would stay below $35/month.
He passed the Infrastructure that trump only talked about.
He passed a CHIPs act, bringing semiconductor manufacture to America.

The midterms in 2022 were supposed to be a bloodbath for Democrats.
"A red wave," Republicans threatened would happen.
It was nothing of the sort.
The GOP is clinging to a tenuous majority after ousting their House Speaker.

And NOW, they've tanked a border security bill that would have addressed the very same issues they've been saying is of dire importance, because otherwise trump would have NOTHING to complain about.

President Biden doesn't brag about how rich he is.
He doesn't disrespect Veterans.
He doesn't ridicule disabled people.
He doesn't have 91 felony counts against him.

There has been no golfing.
There have been no petty, childish beefs.
There has been no insane, ALL CAPS rage tweeting.
Just serious work for the American people.

That's why President Biden is going to defeat trump AGAIN in November.

He's got MY vote, for sure.
