Norway’s Flawed Legal System: The Unlawful Extension of Dr. Cho Ayaba’s Detention and a Grave Human Rights Violation

The ongoing detention of Dr. Cho Ayaba by Norwegian authorities has crossed every boundary of justice, legality, and human rights. For over five months, Norway has held him in detention without charge, without trial, and without any credible evidence of wrongdoing.

Under Norwegian law, specifically article 183 of the Criminal Procedure Act (*Straffeprosessloven*), a suspect must be brought before a court within three days of arrest. Pre-trial detention can be extended, but such extensions require substantial justification and are subject to strict time limits. The law mandates that if the prosecution fails to present substantial evidence within a reasonable period, the court must dismiss the case and order the accused's release. In Dr. Ayaba’s case, this legal safeguard has been completely ignored. Five months have passed, and Norway has still not produced any credible evidence.
Dr Cho Ayaba’s detention has been unjustly extended over four consecutive times giving the same flimsy excuses of fear of tempering with evidence and conducting more interviews.

Instead of upholding its own legal principles, the Norwegian judiciary continues to grant one baseless extension after another, keeping him in detention under circumstances that have never been applied to any other political figure in Norway’s history.

This is nothing short of judicial bias, institutional racism, and a gross violation of fundamental human rights. How can Norway, a nation that prides itself on democracy and the rule of law, justify such an unprecedented miscarriage of justice?

Dr. Cho Ayaba is not just an individual. He is the leader of the Ambazonian liberation movement, and his detention is a clear attack on the struggle for self-determination. This is political persecution, disguised as legal procedure.

Dr. Ayaba’s detention not only breaches Norwegian law but also violates **international human rights protections**, specifically:

1. European Convention on Human Rights (ECHR):
- Article 5(1) – Right to Liberty and Security: “Everyone has the right to liberty and security of person. No one shall be deprived of his liberty save in the following cases and in accordance with a procedure prescribed by law.”
- Article 5(3)– “Everyone arrested or detained shall be brought promptly before a judge... [and] shall be entitled to trial within a reasonable time or to release pending trial.”

The repeated extensions of Dr. Ayaba’s detention without charge and the lack of a reasonable time frame for trial clearly contravene these fundamental rights.

2. Universal Declaration of Human Rights (UDHR):Article 9 &10.

These international standards make it clear that prolonged detention without trial and the failure to provide a fair process are blatant violations of Dr. Ayaba’s human rights and dignity.

We call on the Norwegian government, the judiciary, and the international human rights community to put an end to this malicious prosecution. Dr. Cho Ayaba must be released **immediately**. His continued detention is not only unlawful but exposes Norway’s hypocrisy in matters of justice and human rights.

**Open Letter to Kripos: Immediate Release of Dr. Cho Ayaba and Condemnation of Unlawful Detention**

To the Norwegian Criminal Investigation Service (Kripos),

We urgently call upon Kripos to uphold the principles of justice and human rights by ending the unjust detention of Dr. Cho Ayaba, a European citizen, who has been held without conviction for over a month. This continued detainment is a blatant violation of European and international human rights laws, as well as Norway’s own national legal standards. Dr. Ayaba’s confinement is an affront to the rule of law and a troubling indication of Norway’s potential complicity in foreign state repression.

Norway has built a global reputation as a champion of human rights and an advocate for international justice. Yet Kripos’s role in this matter, aligning with Cameroon and France, reflects a stark contradiction to these ideals. The detention of Dr. Ayaba, a recognized leader advocating for self-determination and fundamental freedoms, reveals a disturbing shift that tarnishes Norway’s commitment to democratic values and erodes the trust placed in its institutions.

Cameroon has long been a tyrant and oppressor, systematically violating the rights of the people of Ambazonia. Dr. Ayaba stands as a victim of Cameroon’s relentless impunity—a leader fighting for justice who has been wrongfully targeted to silence his voice. In a disturbing display of manipulation, Cameroon portrays itself as a victim, seeking to deflect attention from its own crimes while evidence of its abuses is available for all to see. This dangerous narrative not only shields the regime from accountability but also underscores the urgent need for nations like Norway to reject such deceptive tactics and support genuine human rights defenders.

This collaboration between Kripos, Cameroon, and France not only undermines Dr. Ayaba’s rights but also Norway’s credibility. By participating in the efforts of two nations that have consistently suppressed the voices of Ambazonian activists, Kripos is allowing its name to be used in a campaign of repression that stands in opposition to the principles Norway has long promoted on the international stage. This selective stance on human rights damages Norway’s moral authority, creating a narrative of hypocrisy that will not be overlooked by the global community.

We strongly urge Kripos to act without delay in releasing Dr. Ayaba and restoring Norway’s image as a defender of human rights. This moment calls for decisive action—an opportunity for Kripos to affirm that Norway’s justice system is not a tool for political persecution but a defender of fundamental freedoms. The world is watching closely as Kripos decides whether to be a pillar of justice or an enabler of oppression.

**Norwegian Government: Respect Human Rights and Rule of Law – Release Dr. Cho Ayaba**

Dr. Cho Ayaba’s arrest on Sept 24, 2024, for alleged incitement of crimes against humanity in Cameroon is a violation of his rights. For nearly a month, Dr. Ayaba has been unjustly detained without conviction, in clear political persecution aided by Cameroon’s regime.

Norway’s actions violate the **European Convention on Human Rights (ECHR)**:

1. **Article 5** – Right to liberty and security. Dr. Ayaba’s prolonged detention without evidence is unlawful.
2. Article 6– Right to a fair trial within a reasonable time.
3. Article 10– Freedom of expression. His arrest is an attack on his right to speak out against Cameroon’s human rights violations.

This also violates the **International Covenant on Civil and Political Rights (ICCPR)**:

1. Article 9– Right to liberty and security.
2. Article 19– Right to freedom of opinion and expression.

Under **Norwegian law**, **Section 94** of the Constitution protects against unlawful deprivation of liberty. By law, no one can be held for more than **48 hours** without being brought before a judge (**Section 183, Criminal Procedure Act**), yet Dr. Ayaba remains in detention without justification.

Norway must uphold its legal obligations. Dr. Ayaba is being persecuted for peaceful advocacy against a brutal regime. Norway must act now to prevent further injustice and release Dr. Ayaba immediately.

📢 We demand that the Norwegian Chief Justice take immediate action for the release of Dr. Cho Ayaba, who has been wrongfully arrested in collaboration with Cameroon.

Dr. Ayaba is a dedicated human rights activist, a freedom fighter and a defender of justice, not an oppressor. Cameroun has been playing the victim card in collaboration with the international community to hunt and arrest dissidents. This is to stop. Ambazonia is the victim here not Republic of Cameroun.

The detention of Dr Cho Ayaba, undermines the principles of international law and human rights that Norway stands for.

Cameroon, on the other hand, is responsible for severe human rights abuses and atrocities in Ambazonia, including mass killings and summary executions.

We urge the Norwegian authorities to recognize Dr. Ayaba’s vital work in advocating for the rights of the marginalized and to hold those truly accountable for these violations. Justice must prevail!
