Uganda’s Constitutional Court has ended the automatic acquittal of suspects who suffer torture at the hands of the state. The Court ruled that victims of crime also have a constitutional right to a fair hearing and that courts should not terminate criminal proceedings solely because state agents violated a suspect’s rights.
The Court struck down Section 11(2) of the Human Rights (Enforcement) Act, meaning that suspects who allege torture must now stand trial while pursuing separate legal remedies for the abuse they suffered.
At Agora, we believe this ruling marks a major setback for human rights in Uganda. By allowing prosecutions to proceed despite state-sponsored torture, the justice system is normalising abuse and reducing accountability for those who commit it. When the state tortures its citizens, it forfeits the moral authority to prosecute them.

Yesterday when Nabbanja was asked about Kibalama’s whereabouts whom she had prior said was in state custody, she replied mockingly that she had been referring to her LC1 chairman. For context, Kibalama’s wife also died, the children are helpless. Abuse of power aside, one wonders what happens to people like Nabbanja for them to start viewing other people’s lives as worthless, as casual or as disposable.

Warning against the violence witnessed in recent polls like Kawempe North, Rubongoya urged residents to vote for NUP’s Irene Nampala to fulfill the legacy of the late Helen Nakimuli.
The by-election aims to fill the vacancy left by Nakimuli, who tragically passed away in April following surgery, weeks before swearing in for her second term.
