That's the actual gate. The criteria are functional, and they're coextensive with how disability is defined elsewhere in Canadian law etc. Anyone who qualifies is disabled in the legally operative sense, whether or not they'd ever use that word for themselves. The "or" in the statute answers a drafting question, not an equality one, the law is judged by who it selects for in practice, not by what the text could theoretically admit. And if the broad definition implicates Track 1 too, that's confirmation, not a flaw. Reasonably foreseeable death was a political line Parliament drew, not a human rights boundary, and the suggestion that pointing this out reveals a hidden agenda against MAID generally doesn't follow. A principle having further logical reach isn't an admission of intent. This position is Track 2 repeal, Track 1 reform, stated plainly, not something you get to infer instead.
Here's the part that actually matters most. When reasonable forseeable was the criterion, the assessor's job in theory was confirming a medical fact, an already dying process, and the choice in front of the patient was about how that death happened, not whether it happened. That's a real clinical decision, sedation versus another method, within a trajectory already in motion. Once reasonably foreseeable death is removed, that's gone. The assessor is no longer confirming a death already underway. They're certifying that a person is competently choosing death over continuing to live. That is not the same kind of decision, and it cannot be assessed the same way, because it isn't a medical fact. It rests on an unstated premise, that death can be the more dignified, better outcome than living with a given disability. No instrument measures that. No clinical training certifies it. It is a value position about whose life is worth continuing, held by the assessor, not discovered by them, and dressed in clinical language it hasn't earned.
Irremediability cannot be proven. Not weakly proven, cannot be proven, because it's a claim about a future that hasn't happened yet, treatments not tried, circumstances not changed. An assessor isn't confirming a fact when they call a condition irremediable. They're offering an opinion about something unobservable in advance. Intolerability has no scale either, no threshold, no external check, it's whatever the person says it is, and you've already agreed it's shaped by housing, supports, and isolation, not a fixed internal state. So the entire structure downstream of "has a qualifying condition" is this: an unprovable judgment about whether a life is worth continuing, stacked on a self report that's already conceded to be shaped by deprivation, and the result gets called a clinical determination.
Saying most disabled people wouldn't meet the standard isn't the safeguard it sounds like. There's a person's account of their own suffering, shaped by what they have and haven't been given, and another person's belief about whether that life should continue. Calling that medicine doesn't make it medicine. Most disabled people not qualifying today is a headcount of current opinion, not a structural protection, and headcounts change.
You've already conceded the actual rights based objection yourself, in your own words. Constrained choices get read as settled ones. Availability changes the social meaning of disabled lives. Housing and homecare failures create pressure toward this option. That's not a side issue you raised and moved past. That's the entire argument.
And the idea that pulling back on this would disrupt access for the majority isn't an answer to any of it. It's a cost argument. Whether a scheme disproportionately harms a protected group isn't settled by counting how many people it serves well. If it does, the answer is reform, regardless of how disruptive that is to people the harm never touched. That's not a flaw in how rights work. That's the entire point of having them. Remember anti inequity not MaiD. 🖖
