“The legislature finds that the rights to acquire, possess, and protect property under Article II, section 3, of the Montana constitution, and the freedom of expression under Article II, section 7, of the Montana constitution, also embody the notion of a fundamental right to own and make use of technological tools, including computational resources.”

NEW: Sen. Daniel Zolnikov has officially introduced SB 212, the Right To Compute Act, to the #mtleg.
This bill will ensure Montanans’ rights to free expression and property are protected in the 21st century, in addition to helping position Montana as a world-class destination for AI and Data Center investment.
Here's what it does:
#1: Establish the Right to Compute: The legislature makes it clear that privately owning or making use of computational technologies for lawful purposes is protected as an aspect of fundamental rights to free expression and use of property.
#2: Create a New Policy Framework: Restrictions on the ability to privately own or use computational resources must be limited to those demonstrably necessary and narrowly tailored to fulfill a compelling state interest in public health or safety.
#3: Balance Interests: Provides mechanisms for policymakers to address real harms to public health and safety posed by the application of new computational technologies, while also ensuring that regulations do not excessively burden the Right to Compute.

Under a strict reading of the AI Act, ChatGPT advanced voice is *illegal* in EU workplaces and schools because the system can recognize a user’s emotions. That’s prohibited by the AI Act.

#FreedomToCompute is freedom of speech.
1) The AI and energy policy debates will fully converge next year and become the most important technology policy issue of 2025 and beyond.
2) This will result in the unholy marriage of anti-AI and anti-energy forces. Basically, doomers meet degrowthers and have a baby named techno-stagnationism.
3) The preferred tool of techno-stagnationists will be the expanded use of highly restrictive permits and open-ended audits. AI opponents are already proposing NEPA for AI to follow the blueprint of what NEPA has already done to slow energy innovation in the United States.
4) If this anti-innovation, techno-stagnationist vision prevails, it will completely derail the computational revolution in the U.S. We need a positive energy abundance vision + an AI freedom agenda or else America will lose ground to China and other nations in the race for global competitiveness and geopolitical security.
5) This should not be a partisan thing. We need policymakers of all stripes to embrace a vision of abundance and opportunity in both energy and artificial intelligence technology for the good of the nation.
