🚨 HUGE Immigration News: new H-1B proposed rule will weight by wage!

Based on your job code and location, your base salary percentile will slot you into one of 4 groups in descending order: IV > III > II > I. Level IV gets 4x tickets in the lottery, III gets 3x and so on.

Overall, it's really bad for startups, early employees, helps IT consulting shops and can be easily gamed.

I outlined the major consequences of this rule below.

What Trump’s election means for immigration:

Be prepared for H-1B changes. A lottery based on salary, increased filing fees, and increased enforcement against job shops.  

Look for higher visa denial rates and longer processing times.

And count on no immigration reform, including no increase in numbers, no changes to per country limits, and even a possible shrinking of legal immigration.

Outside of employment based immigration, look for mass removal operations,  temporary and massive detention centers, many arrests by ICE, stricter scrutiny at the ports of entry.

Prepare for the formal end of DACA, the termination of virtually all TPS programs, the end of asylum as we know it, the end of our refugees programs, and a slow walking on the diversity lottery visa issuance.

According to a report from @NiskanenCenter, just 1,200 H-1B workers have transitioned to Canada under a new visa program announced by Canada in 2023 to attract H-1B workers to Canada. Many treated it as a backup option, showing limited immediate impact on the U.S.—for now.

USCIS currently faces +9 million pending cases. +6 million are "beyond our targeted processing goals."
