The Court of Appeal has reaffirmed a tough, often-ignored rule: a land-sale contract can simply die when the purchaser fails to perform within the timelines they agreed to. In Macho & Another v Athuman & 2 Others (2025), the buyers had paid a KES 572,000 deposit for a Mtwapa plot in 2009, but after Land Control Board consent was issued in January 2010, they failed to clear the balance within the 90-day window required to complete the sale. Years later the land had been sold, developed, and appreciated, yet they still sued for specific performance and were even awarded KES 4 million by the trial court. The Court of Appeal has now reversed that award in full.
The Court held that once the statutory 90-day completion period lapsed, the agreement collapsed automatically. Specific performance cannot arise where the purchaser was the party in breach, and courts will not force transfer of land already sold to innocent third parties. The judgment also clears another recurring misconception: general damages are not available for breach of contract, and appreciation of land value is not compensable unless specifically pleaded and strictly proved. The trial court had gone outside established doctrine; the appellate court brought the law back where it belongs.
This ruling speaks directly to everyday buyers who pay a deposit, delay the balance, and assume the deal remains alive indefinitely. It doesn’t. Once LCB consent issues, the clock starts ticking, and failure to complete means the seller is legally free to move on. Courts will not revive expired contracts or compensate for lost opportunities. The takeaway is blunt but necessary: complete your payments on time, put every extension in writing, and never rely on assumptions that a land deal “will sort itself out.”

The latest victim who checked in to the underground Airbnb was Fred Omondi- who went to meet with his ancestors after falling from a moving kifikifi will drunk, he was equally fighting depression. There's another Churchill comedian who has currently gone mad; he's walking with a sack collecting garbage in Kibera. I've forgotten his name, but he's the one who also sang the song titled Kumjua Yesu Ndiyo Ubabi.
This is the unfortunate situation that most of our comedians are going through. Desagu should get something else to do, the 69 views he's getting in his comedy skits from over 1M views will continue throwing him into depression and mental anxiety. In fact he should forget that he was in comedy completely, failure to that he will keep screaming at night and running around Mwihoko with miss matched slippers shouting 'obnoxious obwedede' at the top of his lungs.
He also needs to stop regretting using his money at his prime to chase skirts and akohoo, a man is to error. Men should learn from Desagu, make hay when the sun shines. I've also noticed one trend, every time a man has hit rock bottom, it's the mother who always rushes to rescue him. We've seen these from Jowie, Kairo, Desagu & many other men.
So Gentlemen, I will keep on singing until you hear me. It is only your mother & a few fathers who will stand with you when those you used to drink with exit the scene when your fortunes start dwindling. Desagu should understand that, Life is hard it's not him alone suffering from depression but lots of people ni vile hawaogei.
Apparently, it was Desagu who sold me my first car at Motorhub along Kiambu Rd, he's a good car sells agent. He should stop feeling sorry for himself, avoid Akohoo, stop that comedy thing, man up & start afresh.
