Perkara:
Seorang laki-laki dewasa merudapaksa anak perempuan usia 4 tahun yang mengakibatkan alat kelamin anak itu terluka. Lalu anak itu dinikahkan dengan laki-laki tersebut oleh ayahnya. Bagaimana hukumnya?
Fatwa Imam Nawawi:
Perudapaksa itu harus membayar denda 50 unta dengan beberapa spesifik yang ditentukan. Dia juga wajib membayar mahar dengan nominal yang berlaku di sana. Hakim lalu memberikan putusan hukum terkait tindak pidana kekerasan yang telah terjadi (pelukaan alat kelamin). Had zina (entah dirajam sampai mati atau dicambuk 100 kali) juga diberlakukan kepadanya.
Terkait hukum pernikahan anak itu dengan laki-laki tersebut, batal dan tidak sah. Ayahnya tidak punya wewenang untuk menikahkannya dengan tanpa konsensual dari anak tersebut.

And the scholars who are truly scholars are also few. For many of the scholars today are either ʿulamāʾ of the state or ʿulamāʾ of the ummah, and rare are those who belong to the ʿulamāʾ of the millah

Shaikh Abdul Muhsin Al-Abbad on the permissibility of publicly criticizing Muslim rulers.
Presenter: The question that is repeatedly asked is regarding the permissibility of openly doing Inkaar (criticism) of the Imams (Muslim leaders) in front of the general public or openly?
Shaikh Abdul Muhsin Al-Abbad Al- Badr: "If no harm results from it, there is no objection. That is, if one witnesses something objectionable, they should clarify it. They should clarify this objectionable matter because when the wrong becomes apparent, denouncing it also becomes apparent as consequence of the wrong's manifestation."
Presenter: There are those who say that there is a distinction between giving advice to rulers (Naseehah) and denouncing what is wrong (inkar-ul-Munkar), say that it is Naseehah (advice) that should be given privately. As for the first matter, it is known that if something wrong is done publicly, then it should be criticized publicly , using Abu Sa'eed Al-Khudri's action as an evidence.
Shaikh Abdul Muhsin Al-Abbad Al-Badr: Undoubtedly, giving advice in private and writing to them or contacting them is without doubt beneficial, and its benefit will be achieved by Allah's permission. However, if something wrong occurs and people witness it, remaining silent about the wrong essentially means accepting it [the evil] and failing to denounce it. Thus, denouncing it and explaining that it is impermissible is similar to what occurred with Abu Sa'eed Al-Khudri.

In the Name of Allah, the Most Gracious, the Most Merciful.
All praise is due to Allah, Lord of the worlds. May Allah bestow His peace, blessings, and grace upon our Prophet Muḥammad, and upon his family and all his Companions.
To proceed: The Westernizers (advocates of Westernization) in the Saudi lands became active starting from the era of King ‘Abdullāh (may Allah have mercy on him), which lasted approximately ten years. They introduced matters foreign to this land, involving an expansion in the pursuit of desires, which leads to a great deviation for this country, as Allah, the Mighty and Majestic, has said: {And Allah wants to accept your repentance, but those who follow [their] passions want you to digress into a great deviation.} [An-Nisā’: 27].
The Saudi lands are the last bastion of preserving Islamic morals and etiquettes, which ensure safety from the ingratitude for blessings that brings about divine retribution.
These Westernizers have particularly targeted the Salmāni era (the reign of King Salmān) with their efforts to establish the General Entertainment Authority, following their endeavors during this era to issue regulations for the Committee for the Promotion of Virtue and the Prevention of Vice (Hay’at al-Amr bil-Ma‘rūf wan-Nahy ‘an al-Munkar) that resulted in its weakening and the loss of its prestige.
Regarding the establishment of this Authority, I have previously stated: “It is feared that it will transgress what is permissible into what is unlawful according to Sharī‘ah, matters from which this land was previously safe, such as the opening of cinemas, which incur Allah’s wrath and destroy morals. I previously wrote an article on this titled: ‘An Exposition of the Danger of Opening Cinemas in the Land of the Two Holy Sanctuaries,’ published on 1/1/1430 H. And [I mentioned] their efforts to appoint a female deputy to the head of the General Sports Authority for the women’s section.” I stated this in an article titled: “An Exposition of the Transgression of the Westernizers During the Salmāni Era and the Era Preceding It,” published on 10/1/1438 H.

1. Al-Nawawī (d. 676 AH)
Seeing as this individual quoted Al-Nawawī, it is only fair that I bring his view on the matter.
Commenting on the report of Usāmah b. Zayd concerning ʿUthmān [r.a], al-Nawawī explains that private admonition is preferable when possible, then states:
“This is all [permissible] when that is possible. But if admonishing and condemning the wrong privately is not possible, then let him do it publicly, lest the foundation of the truth be lost.”

@aburayaan_55 Ignorance of the highest order. Allahul Musta'an. Public criticism of rulers is permissible under certain circumstances as is mentioned in the books of the Salaf.

@AhmadAlkinani@xixye_@EbnHussein1424 Yes it's not a scholarly encyclopedia. Your defence of 'simplification' would've been true if the other things happening around the country aligned with what you want to belive, however it's open to one and all that rampant westernization is taking place.
