@ASFleischman I will say, though, that if you turn Payne into a cop, there is *no way* the State would argue that Herring was "unarmed" (he was driving a car), "non-aggressive" (he was not complying with orders), or that he was "not an imminent threat" (again, driving a car and not complying).
@ASFleischman Yeah I read both briefs and I found the AG/DA's statement of facts to be more persuasive. The multiple eye witness accounts are pretty rough for your client. That said I didn't read the transcripts in the record and it does sound like her trial atty fucked up.

Fwiw I could see them describe it as "severance" but then in the fine print, it wouldn't be.

The Blackhawk was clearly above the 200ft limit of the flight corridor and turned well West of it. ATC shouldโve called for the CRJ to go around. My guess is that corridor will be shutdown when landings are on RWY 33 in the future, especially at night. The CRJ could have just kept their original RWY 1 assignment. Sad turn of events. ๐๐๐

@Whatdidyousay82@PeterHamby ATC is operated by the FAA. This appears to be a joint error by the helicopter operator, who seemed to visually identify the wrong plane, and the controller, who probably should have called off the helicopter rather than asking for the pilot to confirm visuals.
