I do not endorse his behaviour, but he must be heard. He must have been deeply frustrated. Institutions cannot repeatedly harass, ignore and deny justice to a person for years and then examine only his reaction, completely detached from what pushed him to that point.

Even I once spoke loudly before the Tribunal because of the Tribunal’s own conduct.

In my case, I first challenged the charge sheet issued to me by the corrupt IRS for writing a letter to @nsitharaman through the Association, in my capacity as its General Secretary. In that letter, I demanded transparency in the disbursement of crores of rupees from the Secret Service Fund, which is fully misappropriated by the IRS lobby, and an investigation into corruption in the promotion of hundreds of officers beyond the sanctioned strength.

The charge sheet was issued on the ground that the Association’s recognition was under renewal.

The charge sheet was mala fide, fake and totally baseless, so I challenged it before the Central Administrative Tribunal, Lucknow Bench. But instead of protecting me against this abuse of disciplinary power, the Tribunal sat on my petition. It’s also to note tha Tribunal has one member judge form IaS cadre and what I had been raising , its certainly against their lobbies.

Meanwhile, they removed me from service.

I again challenged the removal order before the same Tribunal.

Then the game started.

The respondents kept taking time to file their counter affidavit. The same respondents who issued my removal order within six days failed to submit their counter for one whole year. And the Tribunal said nothing.

After the respondents finally submitted their counter and the pleadings were completed, we pressed for final hearing.

The Tribunal would sit at 10:30 AM and rise at around 12:00 noon. They repeatedly said, “We will hear the matter. List the case above submission.”

But the Registry did not do it. My case was listed at serial number 60, 55 and similar numbers and they rise at 12:00 and postpone my hearing which was urgent.

This happened around five times. Five times, the Tribunal said it would hear the matter and directed that it be listed at the top. I lost 4-5 months again for this not hearing of case.

Finally, I lost patience and spoke loudly, despite my advocate was there and prayed again:

“Sir, this has happened five times. What is this? How many times will you keep doing this?”

Then, at the next hearing, after keeping my petition pending for around one and a half years, after the pleadings had been completed, and despite it being an urgent matter concerning my removal from service and my bread and butter, the judge suddenly said that I should first exhaust the departmental channel and approach the appellate authority.

After one and a half years, I was sent back to the departmental appellate authority.

Courts and Tribunals demand patience, restraint and respect from citizens. Citizens have an equal right to timely justice, fair hearings and accountability from Courts and Tribunals.

अब आपको असली कहानी बताते हैं, जो न मीडिया ने सही से दिखाई और न ही लोग समझ पा रहे हैं कि ये इनकम टैक्स का मामला है या घूस का, और सिंघल साहब इनकम टैक्स में हैं या जीएसटी और कस्टम्स में। और फिर ये डायरेक्टोरेट ऑफ टैक्सपेयर सर्विसेज में ऐसी कौन सी ताकत है जिससे ये घूस ले रहे थे?

असल बात ये है कि आईआरएस अधिकारी काला धन सफेद करने के लिए रिश्तेदारों के नाम पर बिजनेस खोलते हैं, ट्रस्ट बना कर पैसे लेते हैं, और कई फाइनेंसर बिचौलिये रखते हैं जो उनका पैसा लेते हैं और मैनेज करते हैं। मुंबई, दिल्ली, लखनऊ में ये सब आम बात है। ये फाइनेंसर और बिचौलिये खुद एक बहुत बड़ा बिजनेस हैं, जो इन भ्रष्ट अधिकारियों की घूस की रकम को इधर से उधर करने से लेकर उसको काले से सफेद बनाने तक सब कुछ करते हैं।

ऐसे ही एक बिचौलिए के साथ और अपनी मां के नाम से इन्होंने ला पीनो की फ्रेंचाइजी ली, जिसमें इन्होंने तय विक्रेताओं के अलावा कच्चा माल कहीं और से खरीदना शुरू कर दिया। इससे विवाद हो गया। फिर ये लोग ला पीनो वालों पर पैसे देने का दबाव बनाने लगे और धमकाने लगे कि हम ये करवा देंगे, वो करवा देंगे, हमारी पहुंच बहुत ऊपर तक है।

ज्ञात हो कि इनकी पत्नी इनकम टैक्स में एडिशनल कमिश्नर हैं और दिल्ली में तैनात हैं। इसी बीच ला पीनो के डायरेक्टर को इनकम टैक्स से नोटिस आ गया, और सिंघल साहब ने बिजनेस के पैसे वसूलने धमका कर शुरू कर दिए। लेकिन ला पीनो के डायरेक्टर ने भी जुगाड़ लगाया, और सीबीआई से संपर्क करके इन्हें रंगे हाथ पकड़वा दिया। अब बिजनेस विवाद में कोई बड़ा केस तो बनता नहीं था, लेकिन इनकम टैक्स और पॉवर के नाम पर धमकाने और वसूली करने का केस तो बनता ही था। यही किया ला पीनो के डायरेक्टर ने, पहले जुगाड़ लगाया, फिर सीबीआई से संपर्क किया और इन्हें रंगे हाथ पकड़वा दिया।, तो घर पर छापा पड़ा और करोड़ों रुपये बरामद हो गए। यहीं से असली पोल खुल गई।

साथ ही ये भी सामने आया कि इनके पास विदेशी प्रॉपर्टी के कागज भी मिले हैं और अब ईडी भी जांच में लग चुकी है। अब सबसे बड़ा सवाल यही है कि जिनकी पत्नी खुद इनकम टैक्स में है और काले धन वालों को नोटिस भेजती है, उनको पकड़ती है, क्या उसे अपने ही घर में पड़े करोड़ों के घूस के पैसे नहीं दिखे? क्या वो सच में अनजान थीं? उनकी जांच क्यों नहीं होनी चाहिए?

जब मैंने विभाग मुंबई में वर्ष 2011 में जॉइन किया था, तो ये सेंट्रल एक्साइज में सहायक आयुक्त के पद पर कार्यरत थे। बाद में ये कस्टम्स में आ गए और मुंबई में इनके बारे में अनेक चर्चाएं सुनने को मिलीं। बताया जाता था कि ये और इनके एक अन्य साथी आईआरएस अधिकारी करोड़ों रुपए का खेल कर रहे थे और लगभग प्रतिदिन किसी न किसी लक्जरी पार्टी का आयोजन होता था।
बाद में ये संयुक्त आयुक्त बनकर गुजरात चले गए, जहाँ इन्होंने एक आदेश निकाला कि संयुक्त आयुक्त और उनसे ऊपर के सभी अधिकारियों को इंस्पेक्टर द्वारा एस्कॉर्ट करके उनके केबिन तक छोड़ा जाएगा। शायद ये बड़े लोग रास्ता भूल जाते होंगे, क्योंकि जब कोई काम ही नहीं होता तो ऑफिस का रास्ता याद रहना भी मुश्किल हो जाता है। हमने इस आदेश का विरोध किया, लेकिन गुजरात में भी इनका खेल बदस्तूर जारी रहा। अब देखिए भारत की विडंबना, कि जिस अधिकारी को किसी भी अच्छे लोकतांत्रिक देश में अब तक नौकरी से निकाल दिया गया होता, उसे सीवीसी जैसी संस्था में नियुक्त कर दिया गया है। यह ऐसा ही है जैसे बिल्ली को दूध की रखवाली का काम सौंप देना। इनके रिश्तेदार मुंबई में पहले से सक्रिय हैं, जो इनका काला धन सफेद करने का काम कर रहे हैं और इनके प्रभाव का उपयोग करके एक्सपोर्ट इंपोर्ट के ज़रिये करोड़ों की घूस को वैध बना रहे हैं।

अब किस्मत थोड़ी फिसली है और ये पकड़े गए हैं, लेकिन पूरे आईआरएस लॉबी में अभी भी ये संदेश है कि कुछ नहीं बिगड़ेगा।और कल को अगर ये फिर से छह महीने या एक साल बाद नौकरी करते हुए मिलें, तो कोई आश्चर्य नहीं होना चाहिए। विभाग में ऐसे कई अधिकारी हैं जो अरबों रुपये के मालिक हैं लेकिन बेदाग घूम रहे हैं।

और मैं, जिसने भ्रष्टाचार के खिलाफ सूचनाएं दीं, व्यवस्था सुधार के सुझाव दिए और पारदर्शिता के लिए संघर्ष किया, उसे इनकी भ्रष्ट लॉबी ने बाहर निकाल दिया । @FinMinIndia है । भ्रष्टाचार के खिलाफ बातें करना बहुत आसान है, लेकिन उसे रोकने की इच्छाशक्ति किसी में नहीं है। @dgovcbic भ्रष्टाचार रोकने की संस्था नहीं है बल्कि भ्रष्टाचार करने देने और आईआरएस को प्रोटेक्ट करने की संस्था है। नागरिकों को मूर्ख बनाया जा रहा। ये भ्रष्टाचार में लिप्त होते ही हैं @dgovcbic के दम पर। वो भी इनके कैडर का आईआरएस होता है इनके गैंग का मुख्य सदस्य हैं जिसको ख़ुश रखा जाता हैं।

1. CGST निरीक्षक संवर्ग में व्याप्त विसंगतियों से जुड़ा विषय उठाने को प्रशासन के द्वारा गम्भीर दुराचार मानना।

2. कैडर से जुड़े विषय उठाने वाले को नौकरी से निकाल देना।

3. जीविका छिन जाने के बाद की गई याचिका पे निर्णय देने में विलंब करना।
