I’ve highlighted two of the points Richard made in his summary document. Those two points are highly significant.

When I first reached out to Richard I asked him whether the ATO started closely managing him after he raised his concerns.

The answer was YES. Here’s how it works.

1. He was perceived and deemed a risk.

2. Human resources would have been contacted early in the piece.

3. They would have told line managers to closely manage him.

4. That means very close scrutiny of his work and behaviour.

5. Typically, that means lots of emailed instructions and verbal nudging.

In short, micromanagement. Human resource policing and the construction of troubled identity. This is deeply bound up with risk management to the point of paranoia. Particularly where the issues raised reflect badly on the reputation of senior officials.

Where the above is the case the issues raised are seen as being a threat to the ATO and, therefore, the entire tax system.

Given its role of administering the tax system the ATO is a compliance based organisation. That is to be expected.

Unfortunately, that spills over into its internal organisational culture and how it manages its people. What did this mean for Richard? Despite the veracity of issue he raised the ATO did not listen. Instead what they were demanding from him was blind compliance.

They were demanding blind compliance from Richard in relation to an aspect of the ATO’s compliance practices that caused harm to taxpayers.

Everything in relation to Richard was meticulously documented and, as matters were progressed, would have been reviewed and checked by internal legal officers.

Richard had been rendered ‘the other’. A threat early in the piece.

Everything that has happened and been done to him flows from all of the above. Including the lengthy and aggressive use of the legal system to render Richard the problem and, as it were, give the ATO absolution. And I dare say, send a message to all other ATO staff. The message being - Be careful. Shut up and obey

Has the Public Interest Disclosure Act provided a safe platform for whistleblowers in the face of such a culture and the practices that go with it? No.

The role of #MoralDisengagement on normalising all of this? Huge.

You know what ppl like about whistleblowers @AlboMP? It’s the fact that they give up everything, to protect vulnerable members of the community when the Government fails to.

@MurdochCadell gave up his career to call out war crimes and inconsistent management in the military.

He’s now given up his freedom.

You know what people don’t like? Governments who punish the people who look out for our interests, when the Government doesn’t.

I can’t believe my friend won’t see that I’ve tagged him, because he’s in jail.

A wise wise man once said to me, there’s rarely a perfect whistleblower but I’ve never met a badly intentioned one. It is arguable that contrarily, war criminals don’t have awesome intentions. Nor do those who condone it.

Shame on everyone involved in this tragedy. He isn’t perfect, but he doesn’t belong in jail.

I had the absolute pleasure of spending time with @Richard_D_Boyle this week, at the @humanrightsHRLC Whistleblower’s project launch and after it. I looked up from the stage and saw his smiling face alongside @WilkieMP, and felt instantly at ease. I was among good ppl.

It was quite honestly, like we’d known one another forever. It always feels like this when I meet other whistleblowers because we all share the same values (integrity and truth) and experiences (mostly horrific ones).

I know criminals, I’ve worked with them for years. Let me just say, this guy, ain’t one of them. He loves his wife and his cat more than anything, and spends his time reading and learning about the world around him. He plays violin like his wife (check her out! Next level @LouiseBeaston) and ordered juice when I ordered a cocktail ❤️

A criminal worthy of federal prosecution, he is not. Like all of us, he has been through enough. Let him go 🙏😔

Prosecuting a man who is SO clearly, just someone who tried to do the right thing, is a horrific waste of tax payers money. Perhaps tune into the @Tasmania_COI and the 100 police referrals of child sexual abusers that they made which need prosecuting. That would be an infinitely more wise and more urgent way to spend the precious resources of the CDDP. ❤️
