🚨India’s New Rental Rules 2026: Key Changes Explained

1. Security Deposit Cap

🔹For residential properties, landlords can charge a maximum of 2 months’ rent as a security deposit.
🔹For commercial properties, the limit is 6 months’ rent.

2. Mandatory Written Rent Agreements

🔹All rental agreements must now be written and formally registered.
🔹Registration generally needs to be completed within 60 days.

3. Clear Rules for Rent Increase

🔹Rent can typically be increased once a year.
🔹Landlords must provide at least 90 days’ notice before increasing the rent.

4. Stronger Tenant Protection

🔹Tenants cannot be evicted without valid reasons.
🔹Eviction is allowed only in cases such as non-payment of rent, property misuse, agreement expiry, or landlord’s personal requirement.

5. Rent Authority for Dispute Resolution

🔹A Rent Authority and Rent Court system is proposed to resolve disputes between landlords and tenants.
🔹Cases are expected to be settled faster compared to traditional civil courts.

6.Tenant Privacy Protection

🔹Landlords must give prior notice (usually 24 hours) before entering the rented property.

7. State-Level Implementation

These rules are based on the Model Tenancy Act framework, meaning each state can adopt or modify them before implementation.

Vijayanand Road Lines (VRL) is India's largest fleet owner. This company owns approximately 7,000 trucks and buses and has branches throughout India.
To secure a driver position at this company, even with 15 years of experience, one must submit all required documents. A character certificate from the local village head/councillor, or from the police station, is mandatory.
Then there's a test, followed by a month of training. After completing all of this, the driver must work as a second driver for a year or two before obtaining their own vehicle.
The company provides all benefits, including group insurance for family members in the event of accidental death, education for children (including postgraduate education for girls), and a pension after retirement. Only 3-4 out of 10 candidates pass the driver's test.
None of this company's vehicles has ever been seen speeding. Drivers always wear uniforms and seat belts.
The reason...?
Cameras, GPS tracking, and strict company regulations.
The cameras in the night buses' cabins are connected to the Head Office. There's a TV monitor for every 10-15 buses, with an operator monitoring it. If the driver even slightly dozes off, becomes careless, or speeds, a call is immediately made. No bus operates with a single driver.
The accident rate is less than half that of other companies.
If a private operator can do all this, why can't the government?
There is a huge difference between the government and the private sector. The government cannot effect change in the system, even if it wants to. If they try anything, government employees will stage protests and go on strike.
Recently, CJI Surya Kant slammed government trade unions. 'They don't want to work... These trade union leaders are largely responsible for stopping industrial growth in the country,'
Last year, in Uttar Pradesh, the Yogi government implemented a technology system to enable teachers to track their attendance. The teachers protested so much that the government backed down.
