TL;DR. Limiting non-competes to 5 years instead of banning them is the best way to protect company trade secrets without hurting the newer/younger generations of employees.
@FTC @linakhanFTC don’t ban non- compete clauses. Without non-competes, companies are less likely to invest in new employees like me, who have less loyalty to the firm than older employees. Instead, just limit non-competes to be active for the first 5 years of employment …
And companies would invest in their newest employees more frequently, since new employees couldn’t immediately leave for a competitor with their recently acquired knowledge, but would first have to benefit the original company for at least 5 years.

@iankar_ Right but they still have to return that money before they can receive carry. Every dollar that goes into research & eng does not go into investments, so the investments have to be better to compensate. I don’t think it always makes sense for management fees to scale w fund size
