The Commonwealth Lawyers Association and LAWASIA Express Concern Over Interference in Bangladesh Bar Elections.
The Commonwealth Lawyers Association (#CLA) and #LAWASIA have expressed deep concern over repeated reports of interference in bar association elections in #Bangladesh and the harassment and initimidation of lawyers and judges through the filing of fictitious criminal cases.
In a joint statement issued on 8 June 2026, @cla_lawyers and @LAWASIA_alerts raised serious concerns regarding interference in several recent bar association elections in Bangladesh, including the #SCBA election.
The statement referred specifically to the obstacles faced by lawyers seeking to participate in the recent SCBA election. Despite meeting the requisite qualifications, multiple eligible lawyers were denied nomination by the current SCBA administration without a hearing, written explanation, or formal decision being communicated to them.
According to the statement, some lawyers were denied nomination on the basis of their alleged political affiliations, while others reportedly had their nomination papers rejected on the grounds that they were considered “collaborators of fascists.”
The statement further expressed concern that approximately 200 lawyers perceived to be supportive of the #AwamiLeague were unable to participate in at least 13 bar association elections held since January 2026.
CLA and LAWASIA also noted reports that former judges of the Supreme Court and practising lawyers have been named in multiple criminal cases involving serious allegations. Some of these cases are alleged to be entirely fictitious, and those targeted have reportedly been subjected to criminal intimidation and threats.
In their statement, CLA and LAWASIA called upon the Govt of Bangladesh, the SCBA, the Bangladesh Bar Council, and other relevant authorities to:
- Ensure the immediate cessation of any interference in bar association elections and guarantee that all elections are conducted freely, fairly, and in strict accordance with the constitutions and rules governing each association.
- Ensure that all qualified lawyers are permitted to contest bar association elections without discrimination based on political affiliation, past associations, or any other ground not recognised under the constitutional requirements of the relevant bar association.
- Immediately review all criminal cases filed against former judges and practising lawyers that are alleged to be fictitious or politically motivated, and ensure that no individual is subjected to criminal prosecution as a means of intimidation, harassment, or the suppression of legitimate professional activity.
- Reaffirm their commitment to the independence of the legal profession as a cornerstone of the rule of law, access to justice, and the protection of human rights in Bangladesh.
The statement underscores growing international concern regarding the integrity of professional legal institutions, the independence of the legal profession, and the ability of lawyers in Bangladesh to participate freely in professional associations without discrimination or intimidation.

According to Transparency International Bangladesh (TIB), during the first 100 days of the BNP Govt, 188 #journalists faced #harassment in 130 separate incidents. During this period, 12 criminal cases were filed against journalists and seven were arrested. TIB also raised concerns about potential violations of freedom of expression through the misuse of controversial provisions of the Cyber Security Act 2026.

At BD Watch, we have been documenting the state of #pressfreedom under the Prime Minister #TariqueRahman-led BNP Govt over the past three and a half months. The statistics from May 2026 remain deeply concerning.
According to the Human Rights Support Society (HRSS), May witnessed 39 incidents of harassment and intimidation involving 79 journalists. Among them, 42 journalists were physically assaulted, 18 were harassed, and 9 were threatened while carrying out their professional duties. One journalist was arrested during the month.

In its latest report on Bangladesh, @CIVICUSalliance highlighted the continued detention of five journalists, the filing of what it described as baseless charges against a further 140 journalists, an army raid on a #media office during which 21 individuals were detained, travel restrictions imposed on the #Dhaka correspondent of the German news agency @dpa_intl, and the initiation of fresh proceedings before the Int’l Crimes Tribunal (ICT) against detained journalists Mozammel Babu and Farzana Rupa.

By the same token, the Committee to Protect Journalists (CPJ), in its latest statement on Bangladesh, urged the BNP Govt and PM Tarique Rahman to release the five imprisoned journalists, withdraw politically motivated cases against media workers, end political vendettas targeting the #press, protect journalists and media outlets from #mob violence, and halt smear campaigns directed at journalists on the basis of their perceived political affiliations.

The devastating implications of the ban on Bangladesh Chhatra League, the student organization associated with the Awami League, have received little to no attention.
Against this backdrop, @GaziSangita's discussion of the legal issues and human costs arising from the ban deserves serious consideration.
In her latest article for @Diplomat_APAC, Sangita highlights a number of troubling consequences stemming from the ban on the organization. One of her central concerns is the apparent retroactive effect of the ban. Students who were associated with Chhatra League before it was outlawed have reportedly been expelled or suspended from educational institutions on the basis of those past affiliations, even though such associations were lawful at the time. As she writes:
"In a democratic society, a government cannot retroactively classify a past action as a crime, with punitive consequences that were not a crime at the time the law was enacted."
Equally concerning are the due process implications. As Sangita writes, the expulsions and suspensions were imposed without hearings, investigations, or opportunities for students to defend themselves. In some cases, students were not even informed of the specific allegations against them.
Instead, they received simple show-cause or administrative notices effectively informing them that their academic lives had come to an abrupt end.
Beyond the legal concerns, the author also draws attention to the profound human cost of the ban. Many affected students reportedly find themselves socially ostracized and treated as outcasts. Many have gone into hiding out of fear of arrest, harassment, or retaliation.
The personal stories are particularly striking. One student has reportedly not returned home in two years. Another was unable to attend the funeral of a close family member. In numerous cases, criminal cases have been filed not only against students but also against their parents, extending the consequences far beyond the individuals directly involved.
The psychological toll appears severe. Living under constant uncertainty, social stigma, and fear has left many struggling with anxiety, isolation, and despair. According to Sangita's account, some affected students have experienced suicidal thoughts.

Whether one supports or opposes the Chhatra League as a political organization is ultimately beside the point. The questions raised in this article concern broader principles: due process, protection against retroactive punishment, access to education, freedom of association, and the human consequences of collective punishment.
These are issues that deserve careful scrutiny in any society committed to the rule of law and fundamental rights.

When 27-year-old Bangladeshi lawyer Zakaria was returning from a wedding, police stopped him at a checkpoint. After conducting a thorough body search and verifying his ID, the officers asked to inspect his mobile phone.
When Zakaria challenged the instruction, the police replied that #AwamiLeague supporters were taking out processions and hence, such additional measures were ordewred by their superiors.
At least the police were being candid about their actions. They did not invoke lofty justifications such as national security. They were checking phones to identify Awami League supporters as part of the ongoing nationwide crackdown on the party.
Speaking to @ProthomAlo, Zakaria said that his cousin in Chattogram had recently faced a similar experience, with police examining everything on his phone. The newspaper reported receiving multiple accounts of people being stopped at checkpoints across the country and having their personal phones searched by police.
Videos of individuals reacting to such checks have also gone viral on social media. It has been alleged that police officers are going through people's photo galleries, WhatsApp and other communication apps, as well as their Facebook accounts.

The incidents have raised an important question: do the police have the legal authority to conduct searches of this nature? More specifically, does searching a person's mobile phone violate the right to #privacy?
According to legal experts, such arbitrary searches of citizens' bodies, mobile phones, and private communications, incl. social media messages, while they are travelling is a clear violation of both the Bangladesh Constitution and international law.
Article 32 of the Constitution of Bangladesh guarantees that no person shall be deprived of life or personal liberty except in accordance with law, while Article 43 protects the privacy of correspondence and other means of communication.
Search procedures must also comply with established legal safeguards. In many cases, searches are reportedly being conducted in front of cameras, with videos later circulated on social media. This can amount to a further violation of individuals' rights, particularly when done without their consent.
International human rights law also places strict limits on searches of personal mobile devices. Police do not have an unlimited right to inspect people's phones. Because mobile phones contain highly sensitive personal information, any search must satisfy well-established legal standards.
The right to privacy is protected by Article 17 of the Int’l Covenant on Civil and Political Rights (#ICCPR), which prohibits arbitrary or unlawful interference with privacy. Similar protections are found in Article 12 of the Universal Declaration of Human Rights (UDHR).
Phone searches should be authorised by law and carried out in accordance with clear legal procedures. Authorities must have a legitimate reason for conducting a search, and the intrusion must be proportionate to that purpose. Blanket or random searches are difficult to justify under this standard.
Searches should not target individuals solely because of their political beliefs, party affiliation, ethnicity, religion, or other protected characteristics.
Int’l law also protects the rights to hold political opinions and to associate with political groups. Accessing phones to identify political activists can raise serious concerns under Articles 19, 21, and 22 of the ICCPR if such actions chill or restrict the exercise of those rights.
