I, Klingon warrior, demand EPA establish a #2ndaryNAAQS for GHGs under #CleanAirAct! Use the law you got, humans. #Textualism#MQD
Read Clean Air Act §§108-110!
P.S. Me stand corrected! @YouthvGov win @ Dist. Court! Go small humans & lawyers! But me wonder practical application. Me worry it arbitrary & capricious. Ok, consider climate impacts from projects, but it always drop-N-bucket v. no project resulting in emissions too small! #Hard
By "landmark," NYT means useless red herring that will do nothing but signal the virtue of the young plaintiffs & their lawyers. Like, what remedy do you expect? Of course Gerrard has his 2 cents. Go 4 it, but there's actual NAAQS law still sitting unused. https://t.co/Z1u6OTa3Tm
@simontrose@isa2c@HoustonTX Not with DA Kim Ogg in charge of @HarrisCountyDAO. HPD: "Like, are you dead?" Victim: "No." HPD: "Yeah, Ok, yeah, we don't prosecute crimes to protect victims unless you are dead, mm-K? Ok. Be safe out there."
Human, the law profs at Columbia & Harvard that ALL liberal climate journos defer to & Biden EPA want cheerleading 4 THEIR ideas! They not want YOUR ideas 4 MORE powerful & durable—but LESS arbitrary & capricious—GHG reg under #CAA. If elite enough, you can ignore academic lit!
Compare their argument for a GHG *Primary* NAAQS in the academic lit: https://t.co/mv1Mhuszfh
W/ my subsequent arg for a GHG *Secondary* NAAQS in the academic lit: https://t.co/UjObuNymB8
Kind of a big issue I think, but no debate or official RE in the academic lit just yet.2/2
@TheQuirke@dwallacewells Use the left's shibboleths, human! Don't call the environmental coastal elite "the environmental costal elite"! Be more actvisity!!! With outrage!!!
@alexcguillen Shrug. The case is useless. NYT loves those young plaintiffs tho, and covering other important things like how climate change is increasing the cost of tampons. Meanwhile, seven state AGs are threatening to sue EPA to establish a GHG NAAQS under actual law with actual remedies.
@Maya4EJ@MichaelGerrard Wow. This is almost 3 yrs old Maya. Ya, still waiting on a RE in the academic lit. In the sciences, one can't ignore a published journal article directly challenging the args of one's own article & prevail w/ a "he's a bit weird" tweet to your tribe.
Can u do that in the law?
"The stressed-out, stretched-thin @EPA is scrambling to write about a half dozen highly complex rules & regulations that are central to President Biden’s climate goals." -@LFFriedman
