Imagine having an Aadhaar card, voter ID, passport, land records and other documents proving you are an Indian citizen, and still being picked up from your home at midnight and sent to a detention centre because you are accused of being a Bangladeshi.

This is happening to Bengali Muslims in West Bengal.

According to Scroll’s report:

> Since June, at least 9 Muslim men and 2 children have allegedly been picked up from their homes, mostly during midnight raids, on suspicion of being Bangladeshi nationals.

> Families of several detainees say the police did not show them any warrant, FIR or remand order and did not give them a proper opportunity to prove their Indian citizenship.

> At least 4 of those detained had reportedly cleared the Election Commission’s recent SIR scrutiny.

> 61-year-old Ibrahim Sheikh was allegedly taken from his home around 12:30 am despite having an Aadhaar card, voter ID, pension papers and land documents. His family says they were later told that he had been sent to a detention centre.

> Jalil Akhtar was allegedly picked up while sleeping on his verandah. He was later handed over to the BSF for deportation, but the BSF reportedly returned him after he maintained that he was an Indian citizen. Police subsequently filed a case against him under the Immigration and Foreigners Act.

> Abdul Jabbar was allegedly picked up along with his two minor sons. His family says he possesses an Indian passport, birth certificate and voter ID and had voted in the recent Bengal Assembly elections.

> Sahin Sheikh was allegedly detained and, according to his lawyer, an FIR was filed nearly 20 days later after an alleged attempt to send him to Bangladesh failed.

Bengali Muslims are being harassed and detained despite having documents proving their Indian citizenship, yet the national opposition seems completely silent.

If they cannot even speak up when people are being picked up from their homes and sent to detention centres, then what exactly is the point of having an opposition? Who will stand up for these people?

In the Ram Janmabhoomi case, the apex court held that no other disputes concerning places of worship would be entertained or reopened. The judge who ostensibly authored this judgment later upheld in the Gyanvapi mosque case the order directing the ASI to ascertain whether a temple existed on the site where a mosque now stands. This was done on the specious ground that it was only an inquiry and not a decision on the matter. This order has opened the floodgates of litigation, which will impact the fraternity among communities and is, in my view, a decision taken to appease the majority : Justice Deepak Gupta
