The recent Waqf Amendment Bill of the Central Government is an infringement on the very concept of Waqf in Islam and a deterrent to its central idea. The Kerala Muslim Jamaat and the Indian Muslim community are deeply concerned that this when enacted, may virtually dissolve the Waqf Board and divest it of its essential functions.

The circulated Bill alone has more than 40 amendments, and some of these majorly undermine the dignity and autonomy of the Waqf Board. It has nothing to do with better management of Waqf properties but everything to do with excessive control by the government. This move away from legally mandated oversight to overreach is most alarming in its threat to the integrity and very existence of the Waqf system.
One of the most disturbing amendments is the transfer of properties to Waqf only after full compliance with revenue rules, which is likely to spawn unnecessary bureaucracy and militate against the formation of new Waqf properties. Also, the nonsensical induction of two non-Muslim members to the Waqf Board itself—related to the Muslim faith intrinsically—is unjustified.

Now, if this Bill goes through, it will open the way for squatters easily to acquire the Waqf properties, already a big problem in the country. Indeed, this has been of serious concern, particularly when one considers the going-on encroachments on the Waqf properties.

Another alarming aspect of the Bill is the proposed power to the government for fresh inspection of Waqf properties declared as "disputed lands." This becomes particularly worrying given conspiracies across the country whereby Muslim shrines and Waqf properties are being declared disputed. The stand that the government takes on these properties will be crucial in the coming days.

Given the foregoing concerns, the Kerala Muslim Jamaat and the whole Muslim Ummah of this great nation strongly demand that the Central Government withdraw this Bill forthwith. We further call for open dialogue by the government with the Muslim scholarly leadership and organizations on matters raised as a result of the proposed amendments.

The sanctity of Waqf properties and the autonomy of the Waqf Board are related to the religious and social welfare of the Muslim community in India. #WaqfBoardAmendmentBill #WaqfAct
