Her guidance is in direct conflict with multiple state statutes and federal law.

Hello Auditors,

We’ve been doing our due diligence in investigating the claims sent to you all recently and coordinating with the appropriate agencies to get clarification.

Regarding the EAC and VVSG compliance: We have discussed this with the EAC’s certification team, bringing up the ballot images in particular. They have informed us that we ARE in compliance, and that turning off the images DOES NOT take us out of compliance.

Regarding the ballot images and data retention: We have received confirmation from the EAC that ballot images are NOT mandated under the certification required for the tabulators.

As for the audit trail: The EAC has also informed us that ballot images are NOT considered part of the audit trail.

If an incident WERE to arise alleging fraud or other criminal activities, the images would not be required to audit that activity. Between ourselves, you all, and relevant law enforcement agencies, we have more than enough capability to investigate without these images. South Dakota HAS and ALWAYS will retain the actual ballots which would be used in a recount, audit or looked at if there was a court order, not the images.

Best cybersecurity practice dictates that unused features in a system be disabled or turned off to reduce attack surface. Since, as these emails freely admit, most counties can’t even make use of this feature, AND since it is unneeded for investigations, it is best practice to turn it off.

Hopefully, this answers the most pressing questions. Many of the claims are horribly devoid of context and do not apply to South Dakota’s systems.

Please remember that the South Dakota Office of Hearing Examiners ruled that ballot images and cast vote records (CVRs) are NOT public record. I have that attached for your reference.

The election integrity movement is overlooking a crucial item: it is not enough to get rid of mail-in voting, and machines, and go to paper only, and count them transparently.

In addition: the ballots need to be counted where they are cast! No transport of uncounted ballots.
