By now you all must have read the #G7–#US compromise on #PillarTwo which is basically a G7 agreement to exempt US-parented #MNCs from the global minimum tax, in exchange for the US dropping #retaliatory tax threats. It is astounding how G7 has undermined #multilateral consensus through bilateral coercion without bothering to discuss this with the rest of the signatories to P2. So G7 has allowed the US to set its own terms while denying enforcement rights to other jurisdictions.
Here we are trying to fight against #IFFs and this G7 has weakened global efforts to curb #BEPS, and #digital #taxavoidance which will harm developing countries who were already asked to bear the cost of aligning with the @OECD deal. This is not a compromise, it is a capitulation that legitimises power asymmetry in international tax governance.
To all those supporting the drafting of the #UNFCITC, please keep this in mind:
UNFCITC must include
1. Anti-Carve-Out Clause:
The Convention must prohibit #exemptions or special treatment for any jurisdiction or MNCs, including side-agreements or “dual-track” application of global norms. All signatories must be subject to equal and non-derogable obligations under the Convention.
2. Prohibition of Retaliatory Tax Measures:
Introduce binding provisions that outlaw the use or threat of retaliatory taxes (e.g. #Section899-style penalties) against states exercising their legitimate right to tax within the Convention’s framework.
3. Digital Economy Taxation Guarantee:
Enshrine the right of source countries especially in the #GlobalSouth to tax digital economic activity, regardless of physical presence. This must include mechanisms for simplified profit allocation and withholding taxes for highly digitalised businesses.
4. Mandatory Global Minimum Tax Enforcement:
Codify a universal minimum effective tax rate applicable to all multinational groups, with priority taxing rights to source countries. No state should be allowed to adopt a unilateral standard that undercuts the agreed global minimum.
5. Public Transparency and Treaty Override Safeguards:
Require #public disclosure of all bilateral or plurilateral arrangements affecting tax rights under the Convention. The Convention must override conflicting treaty provisions where such provisions undermine the Convention’s objectives.
6. Independent Dispute Resolution Mechanism:
Establish a politically neutral and independently governed dispute resolution body to adjudicate #treatyabuse, including challenges arising from non-compliance or bullying tactics by larger economies. This can be further unpacked in protocol 2.
7. Special Protection for Developing Countries:
Include affirmative provisions that allow for transitional flexibility and capacity support for low-capacity states, but without sacrificing their taxing rights or subjecting them to norms they cannot enforce.
