@scroogecapital I do agree United actions abuse the IP system but they are not alone. It’s something I hope our country can fix or put an end to some day
@scroogecapital that is the reality of the bio med patent world we live in. United isn’t the only company that enforces patents through lawfare. Regarding Sandoz case the district court and third circuit both found no antitrust violations by United.
@Paperboy2009@jfais20 It was in United’s best interest to make a deal at the time I’m not saying it was a fair offer but I really don’t think it was as unreasonable as everyone is making it seem.
@jfais20@Lucy3370 I’m sure there was a confidentiality agreement by both companies not to disclose figures after negotiations. You gotta look at this from all angles here before judging.
@scroogecapital Let’s see if LQDA addresses it on the Q3 call. All they need to do is make a simple statement claiming the settlement offer was unreasonable if that really is the truth. I doubt they will.
@Gripltandripit I agree with you there IF both of those things happen but those are both huge ifs. TPIP is going to have a very difficult phase 3 trial + potential lawsuit and any path LQDA believes they have with L606 ILD label still involves more ‘327 patent litigation.
@MadCowCapital I don’t doubt United offered a settlement it makes perfect sense for them at the time. I do however doubt the terms of the deal were favorable for Liquidia or else they would have taken it.
@PerryGlasenberg@_Ceiv There were signs the case was leaning towards a LQDA win. The backdating fiasco, win was mostly priced in as the stock hit $90. How unfriendly could the offer have been?
@CodyB1991@PerryGlasenberg could just as easily say LQDA didn’t care about patients if they would risk them losing access to yutrepia on a patent lawsuit when there’s already an offer on the table to avoid that. It was probably a bad deal and they were confident they would win so maybe you can’t blame them
@ChadwickHarambe@Gripltandripit Of course Yutrepia is far superior, I wouldn’t continue to be a shareholder if it wasn’t and I’m confident in the long term outlook of the company but you need to have an open mind and be aware of these arguments. Attacking competitors has gotten very naive LQDA bulls nowhere.
@ChadwickHarambe@Gripltandripit Do you know how long it would take for every single PAH patient to switch from tyvaso to yutrepia? Especially those who handle it well? People act like patients don’t respond at all to tyvaso. United didn’t build an empire from a treatment that dosent work.
@Gripltandripit United is not dying a slow death. They have ILD and IPF locked up. They will still continue to make plenty of $$$ in PAH plus all of these other indications. I’ve been long Liquidia since 2020 just telling it like it is. People bashing United and Insmed have continued to be wrong
