BREAKING: The Chief Judge of Kaduna State, Justice Muhammad Tukur Aliyu, has rejected a request by former Kaduna State Governor, Mallam Nasir El-Rufai, for the transfer of the ICPC case against him from Justice Darius Hyet Khobo to another judge of the Kaduna State High Court.
The decision followed petitions submitted by El-Rufai and his counsel, raising serious concerns about the impartiality of the trial judge and his conduct of the proceedings.
In his petition dated July 6, El-Rufai alleged that Justice Khobo had attended at least three interactions in Kaduna and Southern Kaduna between March and May 2026, where he allegedly made statements indicating that he would neither grant him bail nor ultimately acquit him.
El-Rufai said the alleged meetings took place under the guise of social or family events but involved political, religious and community leaders who, according to his petition, had longstanding political grievances against his administration.
The former governor further alleged that the judge had allowed himself to become an instrument of political retribution, describing the alleged conduct as fundamentally incompatible with the requirement for judicial impartiality.
El-Rufai said he was prepared to provide the identities of those allegedly present at the meetings and other information supporting his claims to the appropriate authorities in camera.
Despite the allegations, the Chief Judge constituted a three-member committee of reputable legal practitioners to investigate the petitions pursuant to Section 111(1)-(4) of the Kaduna State Administration of Criminal Justice Law, 2017.
The committee submitted its report on August 18, after which the Chief Judge informed Justice Khobo that it found no basis for transferring the case to another judge.
Justice Aliyu consequently directed Justice Khobo to continue with the hearing and determination of the matter in accordance with the law and fairness.
The development means that Justice Khobo will continue to preside over the ICPC case against El-Rufai, despite the former governor’s stated concerns about whether he can receive a fair hearing before the court.
El-Rufai had specifically stressed that his petition was not an attempt to seek bail or interfere with the merits of the case or his pending appeal, but a request aimed at ensuring that the matter was heard by a judge whose impartiality was beyond reasonable doubt.

We just received a copy of President Bola Tinubu’s (@officialABAT) filing from just two business days ago. Not surprisingly, President Tinubu has now formally joined @TheJusticeDept’s request for a 10-day extension, which the judge has now swiftly denied.
We surmise that President #Tinubu wants to use any delay to call upon his friends in DC to argue that the release of these files would harm U.S.-Nigeria relations and undermine his ability to work with the United States to combat terrorism and the killing of Christians in Northern Nigeria.
We believe that any U.S. government personnel who improperly attempt to interfere with the judicial or FOIA process on behalf of #Nigerian President #Tinubu to prevent the lawful release of these records should be exposed and fired.
President @realDonaldTrump and the United States do not protect individuals alleged by the DOJ to have been part of a criminal organization that smuggled heroin into the United States.

I don't know him, and we never met.
I have no reason to wish to meet him, either. When they nominated him as the Chairman of the Independent National Electoral Commission, INEC, the nation received the shocking disclosure of his 2020 legal brief to the international community in which he claimed that the violence in the country was a Muslim pogrom against Christians.
The violence affected and still affects followers of all religions and speakers of every language.
For this reason, I, among many others, felt bad about the assertion he made and assumed that he was not a good choice for that office. This country's elections had incrementally got better with each new leadership.
Professor Jega gave the nation its best election since the disputed June 12, 1993, that produced Chief MKO Abiola, now recognised as a duly elected president who did not, however, take the office.
Professor Mahmud Yakubu did the impossible by rallying the civil society, CSOs, and local and foreign observers to approve all his elections.
Not one election under him was ever rejected by any serious observer or CSO.
Now, look at what has just happened in Osun state. Under Amupitan's leadership, the country has attained a transparent electoral process.
Everyone - civil society, the EU, local and foreign observers are commending this standout performance, praising the exceptional skill and determination to improve the process as manifested by INEC's seamless uploading of the governorship election results to its IReV.
With all the loud acclaim that followed, however, I have been asking myself, where is the captain of the ship, Professor Amupitan?
He hasn't picked the microphone, 48 hours hence, or appeared before the TV cameras to proudly show off the success. Where is he?
We are a country of wilful behaviour, chest beating public officials who are proudly and aggressively proclaiming success without achieving half of what we are talking about here. Where is he?
We are not used to seeing this kind of humility, patience, and restraint. Isn't it fair that the man should come out of his shell and dance to the drums in celebration?
Kaduna North politics is heating up as Hon. @B_ELRUFAI sends a cryptic message to his political opponents.
He says he doesn’t use public funds to distribute motorcycles or bags of rice for photo ops. Instead, he focuses on schools, hospitals and legacy projects that will continue to benefit the people even after he is gone.
