@superwuster Could not agree more. Of course, we fought this battle beginning with US West (CA10 1996) and had largely prevailed in NCTA v. FCC (DC Cir 2009).
@TanyaOCarroll This was also the history of the Do Not Call provisions in US law. To be effective, a simple "applies in all circumstances" opt-out was necessary. Economic theory explains why: if the transaction costs for individual opt-outs are too burdensome, consumers will not bother.

In July, the CAIDP has filed a supplement to the complaint.
