Administrative Officer, Casa Rio Housing Federation Dombivali Palava, Chief Clerk Registrar’s Office, Dombivli East
Dear Sir,
We write to express serious concerns regarding the ongoing election process and committee formation for the Casa Rio and Casa Rio Gold Housing Federation, which falls under the “D” category as per the classification under the MCS Act, 1960. We are still awaiting documents requested from 1st July 2025
Key Chronology and Observations
121 May 2025 – Shri Nilesh Khandalkar released the voter list notice for the 2025–2030 term, inviting nominations and objections till 4 June 2025.
2Guidelines shared included:
◦Resolution in federation format from each society.
◦Only Managing Committee (MC) members to represent societies as per Federation Bye-laws Section 35.
◦Meeting invitation to be circulated to all MC members by the Secretary.
339 member societies were listed, and all nominations/objections were submitted by 4 June 2025.
4Shri Khandalkar confirmed that, as per the MCS Act, a federation with 39 members should have a committee of 11 members.
516 June 2025 – Final voter list released by Shri Khandalkar.
6However, discrepancies were observed:
◦Names added that do not align with Federation Bye-laws Section 35.
◦Incomplete resolutions and unsigned MOMs were accepted.
7A letter from Shri Ram Kulkarni’s office (undated) reopened objections from 16–24 June 2025, signed and stamped by him as Election Officer.
813 May 2025 – Shri Kulkarni appointed Shri Khandalkar as the admin officer to conduct elections for this D-category federation.
91 July 2025 – Final voter list released by Shri Kulkarni included:
◦Members with invalid documentation.
◦No adherence to Federation Bye-laws.
10Discussions now suggest forming a Management Committee of 19 members for 39 societies, which implies 51% representation, raising legal concerns.
Legal and Procedural Violations
•Federation Bye-laws Section 35clearly restricts representation to MC members only.
•Section 73CB(11) of the MCS Act (Amendment Act 2013) states that D-category societies (less than 198 members) must conduct their own elections via an appointed Returning Officer.
•Section 73AAA and Model Bye-laws prescribe that societies with up to 100 members must have a committee of 11 members, including reserved categories.
•The proposal to form a 19-member committee for 39 societies is not supported by any section of the MCS Act, 1960, and appears arbitrary.
Concern Regarding Shri Ram Kulkarni’s Role
We respectfully submit that Shri Ram Kulkarni, in his capacity as Election Officer, has:
•Approved nominations that violate Federation Bye-laws and MCS Act provisions.
•Overridden valid objectionswithout documented justification.
•Failed to uphold the legal framework governing D-category housing federations.
•Proposed an inflated committee size without legal basis, undermining democratic representation.
Our Request
We urge your office to:
•Reassess the final voter list and committee structure in strict compliance with Federation Bye-laws and MCS Act, 1960.
•Ensure that only valid resolutions and properly convened meetingsare considered.
•Maintain transparency and fairness in the election process to protect the integrity of the federation.
If Shri Kulkarni Saheb does not intend to follow the Federation Bye-laws, he must initiate a formal amendment process and align all actions with the MCS Act.
We seek your immediate attention and corrective action to uphold the principles of cooperative governance.
All relevant details have been attached, and RTI has also been filed to seek more clarity.

महोदय,
आम्ही, कासा रिओ आणि कासा रिओ गोल्ड सहकारी गृहनिर्माणफेडरेशनमधील अधिकृत प्रतिनिधी, आपल्यास खालील गंभीर बाबीनिदर्शनास आणून देत आहोत:
घटना क्रम व निरीक्षण:
•दिनांक २१ मे २०२५ रोजी मा. श्री. निलेश खंडाळकर यांनीनिवडणूक अधिसूचना प्रसिद्ध केली होती. त्यानुसार नामनिर्देशनव हरकती ४ जून २०२५ पर्यंत स्वीकारण्यात येणार होत्या.
◦प्रत्येक संस्थेकडून फेडरेशन फॉर्ममधील ठराव अनिवार्य.
◦फक्त संचालक मंडळ सदस्यांनाच प्रतिनिधित्वाचा हक्क(बाय-लॉज कलम ३५).
◦सचिवाने सर्व संचालकांना बैठक निमंत्रण देणेआवश्यक.
◦एकूण ३९ सदस्य संस्था नमूद.
•दिनांक १६ जून २०२५ रोजी अंतिम मतदार यादी प्रसिद्धकरण्यात आली.
•मात्र दिनांक १३ मे २०२५ रोजी श्री. राम कुलकर्णी यांनी श्री. खंडाळकर यांना निवडणूक प्रशासक नियुक्त केले असतानाही, त्यानंतर १६–२४ जून २०२५ कालावधीत श्री. कुलकर्णी यांनीपुन्हा हरकत स्वीकारण्यास अधिसूचना काढली. हे अधिसूचनात्यांच्या कार्यालयातून (अनिर्दिष्ट तारीख) जारी करण्यात आले.
•१ जुलै २०२५ रोजी नवीन मतदार यादी प्रसिद्ध करण्यात आलीअसून:
•अमान्य दस्तऐवजांच्या आधारे नावे समाविष्ट.
•संघटनेच्या बाय-लॉज व MCS कायद्याचे उल्लंघन.
•संचालक मंडळ सदस्य नसतानाही नावे समाविष्ट.
•१९ सदस्यांच्या समितीची कल्पना, जी ३९ संस्थांमध्ये ५१% प्रतिनिधित्व सुचवते – MCS कायद्यातील कोणत्याही कलमासअनुसरलेली नाही.
कायदेशीर बाबींचे उल्लंघन:
•फेडरेशन बाय-लॉज कलम ३५ नुसार प्रतिनिधित्व फक्तसंचालक मंडळ सदस्यांकडून होणे आवश्यक.
•कलम ७३CB(११) MCS Act (संशोधन २०१३) नुसार D-कॅटेगरी संघटना (१९८ पेक्षा कमी सदस्यसंख्या) स्वतःचीनिवडणूक प्रभारी अधिकारी द्वारे घेते.
•कलम ७३AAA व मॉडेल बाय-लॉज नुसार १०० पेक्षा कमीसदस्यसंख्येच्या संघटनेसाठी ११ सदस्यांची समिती अनिवार्य.
•१९ सदस्यांची प्रस्तावित समिती ही कायदेशीर नाही; कोणताहीआधार नाही.
श्री. राम कुलकर्णी यांच्या भूमिकेबाबत चिंता:
•बाय-लॉज व MCS Act विरुद्ध नामनिर्देशन मंजूर केले.
•वैध हरकती नोंदवूनही त्याकडे दुर्लक्ष.
•प्रशासक नियुक्त केल्यानंतरही निवडणूक प्रक्रियेत अनावश्यकहस्तक्षेप.
•१९ सदस्यांची समिती कायदेशीर आधाराशिवाय सुचवली.
आमच्या विनंत्या:
१. १ जुलै २०२५ रोजी प्रसिद्ध अंतिम मतदार यादीवर त्वरित स्थगितीदेण्यात यावी. 2. निवडणूक प्रक्रिया फेडरेशन बाय-लॉज व MCS Act, 1960 चे अनुसरण करत पुनः परीक्षण करण्यात यावे. 3. निवडणुकीत केवळ वैध ठराव, बैठक निमंत्रण व विधिपूर्वक स्वाक्षरीअसलेली MOM विचारात घ्यावी. 4. पारदर्शक व कायदेशीरनिवडणूक सुनिश्चित करावी. 5. जर श्री. कुलकर्णी यांनी बाय-लॉज नमानण्याचा निर्णय घेतला असेल, तर त्यासाठी औपचारिक दुरुस्तीप्रक्रियाच आवश्यक आहे.
आपल्या कार्यालयास सादर केलेली माहिती संलग्न असून, RTI द्वारेअधिक माहिती मागवण्यात आलेली आहे.

Subject:- Mr Ram Kulkarni Sub registrar Dombivli working as political agent in Casa Rio Palava election
Honorable Sir
I, Mangesh Patil, Chairman of Persiana cooperative Housing Society Casa Rio Palava, want to give an official complaint of Mr Ram kulkarni about his unfair behaviour toward Casa Rio and Casa Rio gold federation election process.
According to Election notification dated 21/5/2025 where it has been written that point no 4, Meeting agenda and resolution for representative need to be submitted along resolution till 4 Jun 2025
I have submitted below papers
1. Meeting invitation and Agenda notice email dated 24.5.20252. Meeting MOM 25.4.2025 with resolution name Mangesh Patil and signed by 7 people on 25.05.20253. Document submitted on 4 Jun 2025.4.
After submission My name came in the voter list displaced on 6 th June 2025.
But Mr Ram kulkarni issued a new notification for voters list to benefit for few political influencers on dated 16 th June with end date 24 jun 2025.
Mr shrinet Mayank Secretary of Persiana society Casa Rio Palava has given forged paper dated 31/05/2025 to Shri Ram Kulkarni about his nomination. While visiting the office on dated 30/6/2025 at Ram kulkarni. Paper doesn't had signature of the MC member, no stamp on the MOM, Meeting Invitation is not available. I showed him the MOM book where MOM was not part of the book.
I have given all material evidence to him and he was fully satisfied and he assured that Mr Shrinet Mayank's resolution is not as per standard and not signed by chairman and Treasure, only one signature is there and it will be rejected.
But surprisingly voter list displaced Mr Ram kulkarni has added Mr Shrinet Mayank's name was added in list and my name removed.
Mr Ram kulkarni working as political party agent to Dombivali east. Mayank has not shared paper before 4/jun/2025 when meeting has happened on 31/5/2025
Mr Shrinet has pasted MOM in register on dated 22/6/2025, this meeting happened with Invitation to member and Me as chairman, no meeting agenda and invitation has been added in paper which Mr Ram kulkarni sub registrar asked.
Mr Shrinet has not shared resolution with federation and when it is shared it has only one signature which is against guidelines.
Mr Ram kulkarni sub registrar helping some political parties to regularise their illegal resolution and work.
We request you to look into this matter and validate papers, appoint a separate committee on Mr Ram kulkarni and audit his work. When an Administrative officer is appointed to the Casa Rio and Casa Rio gold federation why he is taking keen interest for election.
He is taking his own decision and when takes objection he is saying go to court. Are we supposed to do this when a Government officer is following legal guideline

1. MoM dated 31/05/2025 ( pasted in MOM book on dated 22.06.2025 in after MC meeting dated 22. 06.2025) So this is a forged document2. This meeting was happened online3. only 6 member has signed document but this paper was not available on dated 30/6/2025 in the Registrar office Ram Kulkarni, and this was discussed during objection4. No meeting invitation to any one, Mr Nikest has forged MOM
Please take strict action against Mr Ram Kulkarni sub registrar and Shri Nikest Mayank

Magdelena CHS – Secretary nomination
1. 21 May 2025 Mr. Nilesh Khandalkar Administrator released federation voter list with guidelines who can be member representative from society
2. The Notice released has below points
a. Need a resolution in federation format from society
b. Members from MC will represent in the federation
c. Meeting invitation to be circulated to elect representative to all MC and its responsibility lies with Secretary
3. Notice said that, till 4 Jun 2025 who want to change representative, or any objection need to share at federation office till 5 pm
4. Magdelana society has approved a AGM resolution that Society Secretary will be going to represent date 18 Sep 2023.
5. In 2023, Mr. Manish Gaikwad was secretary so he was representing from Magdelena society till his tenure.
6. Manish Gaikwad was not secretary after May 2025 in society
7. Voter list shared by Nilesh Khandalkar has name of Manish Gaikwad we took objection on his name
8. Magdelena has submitted new resolution on the name of Manish Gaikwad’s sister Mrs. Anita Gaikwad MOM stating dated 01/06/2025 and resolution no 1.
9. Final date of submission was 24 May 2025, but Magdelena has the best privilege
10. MC has overruled the 7th AGM date 18 Sep 2023 resolution which is against MCS act 1960
a. The committee is bound to implement AGM resolutions unless:
b. The resolution is declared invalid by a competent authority (e.g., Co-operative Court under Section 91).
c. The resolution violates the Model Bye-laws or statutory provisions.
d. There is a stay or injunction from a legal authority.
e. the Managing Committee cannot overrule a valid resolution passed in the AGM unless it is legally challenged and set aside. The MCS Act upholds the democratic structure of co-operative societies, where the AGM is the highest decision-making body.
11. So only a secretary can represent the Magdalena society till this resolution modified in AGM
12. Mrs. Anita Gaikwad is not a Managing committee member
13. Now Mr Ram Kulkarni Sub registrar again asked for objections and resolution again from 16th June 2025 to 24 thJune 2025, objection hearing on 30th June 2025 and final voter list on 1st July 2025
14. Members have taken objection on Mrs. Gaikwads name but Mr Ram Kulkarni rejected all objections against Mrs Anita Gaikwad

1. Mr. Ram Kulkarni has appointed below three committee administrative body on order dated 6 May 2025
a. Vijay Kadam – President of Committee
b. Jagdish Magar – Member of Committee
c. Sunil Chavan - Member of Committee
2. Vijay Kadam is defaulter and has not paid maintenance for more than 5 years still Ram Kulkarni has released order on Vijay Kadam’s name
3. Vijay Kadam is not a first owner
4. The order states that this committee needs to work on election process only and they should not take any other important decision.
5. Mr. Magar has called SGM and only called selected members for SGM.
6. SGM notice does not have any stamps, no letter head and other admin body signature
7. Mr. Sunil Chavan Admin body member, who is not invitedto SGM, SGM point discussed in 3 committee meetings.
8. Mr. Sunil Chavan has shared complaint letter and asked not to consider illegal SGM
9. Mr. Vishal Harne and Vikas Tiwari and Ganesh Yadav made complaint and added 20 signs in against this SGM and Vijay Kadam
10. In SGM, Magar and Kadam has approved more than 15 resolutions, SGM itself says not more than 2-3 points
11. Kadam and Magar did not discuss the election process in SGM
12. Only 19 members were present in SGM, But Kadam produced 23 signs
13. Kadam and Magar forged documents in the middle of the night, Photos and Videos are available and shown to Mr. Kulkarni
14. Kadam has given name of Mr Ramakant Gupta’s name against Mr Nitish Yadav’s name as federation member from Morgana ABC
15. Society member Nitish, Sunil, Vishal has as taken objection of legality of SGM and name of Ramakant Gupta but Ram Kulkarni has rejected it
