I wasn’t even going to break this down. But after reading through again, I realised something:

A LOT of Nigerians may not understand just how important this legal development is.

So let me explain it in plain English.

Dr. Von Batten has filed a motion asking the US District Court for permission to enter the Tinubu FOIA case as an amicus curiae.

In simple terms:

A “friend of the court.”

But what exactly does that mean?

And more importantly -

WHY DOES HE WANT TO ENTER THIS CASE NOW?

Let’s break it down.

WHAT IS AN AMICUS CURIAE?

An amicus curiae is someone who is not a direct party to a case but believes they have relevant information, expertise or an important perspective that could assist the court.

They can ask the court for permission to submit arguments.

The judge does not have to accept the request.

But if the court allows it, the amicus can put additional arguments and information before the judge.

And that is exactly what Von Batten is asking to do.

SO WHAT TRIGGERED THIS?

On September 3, 2026, the Nigerian Presidency - Tinubu’s own State House - issued an official statement publicly discussing the FBI records and the court case.

And according to Von Batten’s filing, that statement named him directly and made claims about the FBI records that he says contradict the FBI’s filings and other court documents.

Now here is where this gets interesting.

Because Tinubu has been arguing in the US court that these records involve private information and that his privacy interests should be protected.

But at the same time…

His own Presidency is publicly discussing those same records.

Do you see the problem?

Von Batten’s argument is essentially:

You cannot tell a US federal court, “This information is private. Protect it.”

Then use the official platform of the Nigerian Presidency to publicly discuss that information and make claims about it.

Those two positions are in tension.

And according to Von Batten, the State House’s decision to go public undermines Tinubu’s privacy argument.

His filing puts the argument very bluntly:

“Nigerian President Tinubu cannot ask a federal court to protect his alleged heroin trafficking records on privacy grounds while simultaneously using the power of the Nigerian Presidency to publicly discuss those same records.”

THAT is the argument the judge is now being asked to consider.

And this could matter.

Because if the court allows Von Batten to participate as amicus, the judge would have another party putting this issue directly before her.

That means the court could have before it:

➡️ The FBI’s confirmation of 399 pages of responsive investigative records
➡️ Records involving surveillance, undercover operations, cooperating witnesses and other investigative material
➡️ Wiretap recordings the FBI says were compiled during an investigation involving heroin-trafficking crimes
➡️ And now, Von Batten’s argument that the Nigerian Presidency’s own public statement undermines the privacy position being advanced in court

Think about that for a second.

Tinubu’s legal team is asking the US court to protect these records on privacy grounds.

Then the Nigerian Presidency publicly enters the conversation about those same records.

And now Von Batten is asking the court to consider what that means for Tinubu’s privacy argument.

This is no longer just about what is inside the FBI files.

It is also becoming a question of:

Can you claim something is private in court while publicly discussing it through the official machinery of government?

The judge will ultimately decide whether Von Batten gets to participate as amicus.

But one thing is already clear:

The State House’s decision to go public has created another legal issue for the court to consider.

There is a saying: when you find yourself in a hole - stop digging.
The Nigerian Statehouse kept digging.

On this date, 3rd of September 2024, i lost all sense of fear as a human being. I zeroed my mind for the worst, i made peace with death and my conscience.

Some of you might wonder why pidom is sounding this way this morning, but the truth is, it was on this day, two years ago that the evil government of Tinubu sent me to prison (Kuje prison to be precised) for just being a journalist and a whistle-blower who seeks for accountability, justice, equality, and better life for all Nigerians.

To ensure that i am killed, or kept in prison to rot away for life, this government concocted frivilous charges of treason, terrorism, trying to overthrow government, sponsoring of violent protrest, money laundering and four other charges, and slammed them on my head before Justice Emeka Nwite, at the Federal High Court Abuja. Whereas deep down they knew i am innocent, but they just have to shut me up for life 💔😭

It was on this day my perilous journey in the hands of Tinubu's wicked government started through the courts, so why should i support such an evil president for a second term in office.

(1) They destroyed my life.
(2) They took my freedom.
(3) They stole my life savings in my cryto wallet.
(4) They frozen all my bank accounts.
(5) They withheld my international passport.
(6) They restricted my movement to Abuja alone.
(7) They separated me from my immediate family, most especially my little son who has now turned 4 without seeing his father for over two years.
(8) They caused the various health challenges i am currently battling.
(9) They threw me into huge debts.

Many of you don't know what i Pidom have been through, and still going through in the last two years and one month since i was arrested by this evil Tinubu's government.
Some of you only heard that Pidom was arrested, taken to court, and was granted bail. But unfortunately, my case and story is way way deeper then you all heard.

I was arrested on the 5th of August 2024, but if i should put all together, i spent approximately two months in between two different detention facilities where i was previously held in the most inhumane conditions, and
prison. But my problems, sorrows and pains started the day i walked out of kuje prison. 4th of October, 2024. After meeting up the difficult bail conditions that kept me in prison for extra two weeks after the court had granted me bail.

I walked out of prison to face the reality of this government's evil plans towards me.

My bank accounts all frozen, no access to money to sustain my self and my family. No funds to hire a lawyer for my case. I was tied down in Abuja without a brother, sister, friend, relation, accommodation, etc.
My life was under threat, and my next court appearance was just by the corner.

It was an intense 12 months long legal battle at the Federal high Court with the government.
Brothers and sisters, i suffered oooooo.
The government don't care if i am alive or i die. They don't care if i have a job or not. If i eat or not, if i have roof over my head or not. They took me to Abuja, sent me to prison, granted me bail, and kept me there in frustration. They locked my bank accounts till date, and took everything in my crypto wallet.
They threw me into huge debts, at some point i slept on the street as an homeless man in Abuja.

People i once loved and trusted on twitter sold me out, became their instrument, snitched on me, and spinned all sorts of narratives on twitter just to destroy me.

As sad as my story is, i am still unbroken, unshaken, and my resolve and hunger to see Tinubu out of AsoRock has more than tripled.

If you watch the video below, you will clearly see that i am coughing. I suffered severe health challenge in detention, and i am still battling it tiĺl date.
One of my fingers is not functioning properly due to tight handcuff that caused me nerve damage.

I never knew i will be alive to see today, but our creator had his own unique plans towards my life.

A President and the Endless Question of His Past

As a citizen of no other country, who has never sought foreign citizenship even when doing so became fashionable, my loyalty to Nigeria and my faith in her destiny remain unshaken.

Yesterday, 30th of August, being Sunday, I fervently prayed for our nation and for those entrusted with the solemn responsibility of leadership. I found myself deeply saddened by the direction in which our country is heading.

It is profoundly embarrassing that we have reached a point where a sitting President is asking a foreign court to withhold records concerning his past, particularly records relating to matters of legitimate public interest.

Leadership, in my humble view, demands the courage and humility to confront one’s history — to acknowledge mistakes, provide candid explanations where questions arise, and, where necessary, apologise and seek forgiveness. True authority is strengthened, not diminished, when a leader accepts responsibility rather than seeks to shield uncomfortable aspects of the past from legitimate scrutiny.

This becomes particularly important when questions concern educational credentials. Issues surrounding foundational schooling — primary and secondary — should not remain unresolved or be addressed primarily through legal proceedings. Nigerians deserve clear, credible, and verifiable explanations, especially when such had been submitted in the past.

My deepest concern is the example this sets for more than 200 million Nigerians, particularly the over 30 million young people in schools. The nation’s highest office should exemplify integrity, accountability, transparency, and ethical leadership.

An imperfect past is part of the human condition. What matters is the willingness to confront it with humility, honesty and deep apology, to make amends where necessary and, when circumstances so demand, to place the interests of the nation above personal ambition.

When will our political class fully appreciate that individual ambitions are temporary, while the nation endures? The Presidency is an office held for a season; the moral standards established by those who occupy it can influence generations.

Nigeria is greater than any one person, and the integrity of the Republic must always come before the interests of the individual.

Amid Growing #Heroin Allegations, Tinubu Runs to His Friends in #Europe

A long-held view across #Africa, the Middle East, and South America is that Western powers install or protect puppet leaders to control countries and their resources. Many Nigerians now believe President Bola Tinubu (@OfficialABAT) is such a #puppet and that the hidden records concerning alleged heroin trafficking are the strings.

We may never know whether President Bola #Tinubu has ever traded Nigerian secrets or resources in exchange for protection, but many Nigerians see the past @JoeBiden DOJ’s efforts to keep these records hidden as further proof that Western powers are protecting President Tinubu. Whether that belief is right or wrong, the secrecy is feeding it.

The longer the records remain hidden, the stronger the belief becomes that foreign powers have something they can hold over #Nigeria’s president. This mistrust will remain regardless of the outcome of the @FBI and @DEAHQ FOIA case. This is why Western powers must ensure that Nigeria’s upcoming presidential election is #free and #fair. Anything else heightens the risk of Nigeria going the way of Burkina Faso, Mali, and Niger.

Ladies and gentlemen, I am beginning to feel bad seeing how a promising young man Mr. Dipo CV with a thriving career in the UK lost everything within 6 months.

He became so poor in the UK the moment he chose bigotry, wishing the worst upon Nigerians.

He was sacked back-to-back from two different universities within six months. He tried to start a consulting business, which failed woefully "because it didn't dey."

He became a security guard at Heathrow Airport but was dismissed for reasons I wouldn't want to discuss here and now.

He later secured a role as a security officer at a hotel near Heathrow Airport but received a bad review from a guest and was suspended.

He has lost everything: his teaching job, security job, and mortgage. He has been squatting with a friend and is now considering relocating back to Nigeria.

SeyiLaw might be thinking that I've forgotten about him, but I'm patiently waiting for him.
