The present situation in Azad Jammu and Kashmir requires restraint, constitutional responsibility, and adherence to the commitments already undertaken by all concerned parties.
The Agreement signed on 4 October 2025 should remain the governing framework for managing the current situation. Every signatory and every public authority has a corresponding duty to act in good faith and to honour both the letter and the spirit of that agreement.
The Joint Awami Action Committee is urged to continue pursuing its objectives through peaceful, lawful, and negotiated means, in accordance with the commitments embodied in the Agreement.
Peaceful civic engagement strengthens public confidence and preserves the legitimacy of public demands.
The Government of Azad Jammu and Kashmir is urged to remain fully within the constitutional and legal framework applicable to the territory.
As a territory whose final status remains subject to international determination, public order must be maintained in a manner that respects fundamental rights, including the rights to peaceful assembly, expression, and due process.
Any response to public protest must be necessary, proportionate, and consistent with applicable law.
The Government of Pakistan bears a higher degree of responsibility in relation to Azad Jammu and Kashmir.
Under the constitutional arrangements governing Pakistan's relationship with the territory, as well as the responsibilities assumed under the relevant United Nations framework for Jammu and Kashmir, Pakistan is expected to ensure that governance in the territory remains consistent with those international obligations.
Accordingly, the Government of Pakistan should advise the Government of Azad Jammu and Kashmir to remain firmly within the United Nations template governing the State of Jammu and Kashmir and to avoid any unnecessary or excessive use of force against peaceful protesters.
Resort to coercive measures would risk aggravating tensions, undermine public confidence, and may be inconsistent with the obligations arising from the special legal and political status of the territory.
The Government of Pakistan should also undertake an immediate assessment of whether the existing civil administrative arrangements, including the civil component operating in Azad Jammu and Kashmir under the administrative framework established following the Karachi Agreement, remain adequate to address the present circumstances.
If those arrangements are found insufficient, consideration should be given to an appropriate constitutional intervention that enables Pakistan to discharge effectively the responsibilities it has assumed under the United Nations framework, including the relevant resolutions of the United Nations Commission for India and Pakistan concerning Jammu and Kashmir.
The objective of any such intervention should not be the expansion of executive authority but the faithful discharge of legal and constitutional responsibilities, the protection of life and liberty, and the preservation of conditions conducive to peace and democratic participation.
Compliance with the obligations arising from the Agreement of 4 October 2025, together with faithful adherence to the applicable United Nations framework, offers the most constructive and lawful path towards resolving the present crisis.
Respect for negotiated commitments, constitutional governance, and the rule of law provides the strongest foundation for restoring public confidence and maintaining stability.
Conversely, failure by any party to comply with its legal obligations or with the commitments voluntarily undertaken in the Agreement may give rise to legal and constitutional consequences in accordance with the applicable law.
It is therefore in the interest of all concerned—the Joint Awami Action Committee, the Government of Azad Jammu and Kashmir, and the Government of Pakistan—to demonstrate #restraint, honour their #commitments, and pursue #dialogue within the established #legal and #constitutional framework.
