🏛️ THE CLARITY ACT: PROTECTING CRYPTO COMPANIES — BUT WHO PROTECTS THE VICTIMS?

With the reported D’CENT wallet losses and recent Ledger security concerns, there's an important question Congress needs to address.

What would the CLARITY Act have actually changed?

📜 SECTION 309 — Decentralized Finance Activities

This provision excludes certain activities involving self-custody wallet software and hardware from specific financial regulatory requirements.
In other words, qualifying wallet technology providers could receive regulatory protections without being treated like traditional financial intermediaries.

📜 SECTION 22 — Protection of Self-Custody

The House-passed bill protects Americans' right to maintain hardware and software wallets and conduct lawful peer-to-peer transactions.

📜 SECTIONS 404–406 — Exchange, Custodian & Broker Oversight

These provisions establish regulatory requirements for covered crypto intermediaries, including custody and customer-protection standards.

BUT HERE'S WHAT THE CLARITY ACT DOES NOT GUARANTEE:

❌ Mandatory reimbursement for victims of hardware-wallet compromises.
❌ Specific cybersecurity standards for every hardware-wallet manufacturer.
❌ Automatic manufacturer liability when private keys or seed phrases are compromised.
❌ A guaranteed independent investigation into every reported wallet security incident.

So here's my question:

If legislation establishes clearer protections and rules for crypto companies, shouldn't lawmakers also examine what happens when the technology protecting consumers' assets fails?

Hundreds of individuals have reported losses involving D’CENT wallets. They deserve a transparent investigation and answers about what happened.
Self-custody should not mean accountability disappears.

Protect innovation. Protect ownership. And establish clear standards for security, transparency, and responsibility.

A concerning report is circulating about alleged counterfeit or tampered Ledger wallets sold through CryptoBilis, a Malaysian hardware-wallet reseller.
🔎 HERE'S WHAT CAUGHT MY ATTENTION:
CryptoBilis also advertises D’CENT hardware wallets!
With hundreds of alleged D’CENT victims reporting unauthorized crypto transfers, this raises some serious questions:
🔴 Did any D’CENT victims purchase their devices through CryptoBilis?
🔴 Could there be a supply-chain issue worth investigating?
🔴 Have @Ledger and D’CENT examined whether their customers' reported incidents share any connection?
To be clear: There is currently no established evidence linking this reseller to the D’CENT thefts. But the connection deserves examination.
We need facts, transparency, and accountability — not speculation.

D’CENT Update — A Conversation Worth Sharing

I recently had a respectful and productive conversation with @SMQKEDQG regarding the ongoing D’CENT situation.

Smoke shared that he has been communicating with D'CENT behind behind the scenes, and there appears to be an effort to better understand the situation and explore possible solutions.

Nothing is confirmed, and I don't want to get ahead of anything. But I appreciate Smoke taking the time to engage in an open dialogue and being one of the only couple of influencers speaking out.

At the end of the day, we're all looking for the same thing: answers, transparency, and a path forward for those affected.
