Very important Development today regarding Tamil Nadu Temples!

Many of you are aware that the @tnhrcedept -an unwelcome encroacher in Hindu Temples - charges 12% of the annual income of Temples as "Administrative Fees" for their useless "services".

The 12% collected from all temples are credited to a Fund called "The Hindu Religious and Charitable Endowments Administration Fund" created under Section 96 of the TN HR&CE Act, 1959.

This account is administered by the Commissioner of the @tnhrcedept - He can take money from this account only to defray the expenses of this Department - the running expenses of the Department including salaries and benefits of its officials.

This fund CANNOT be used for any other purposes.

During the DMK regime between May 2021 and April 2026, the various Commissioners including the current Secretary of Religious Endowments Department @kgbias misused the Administration Fund for purposes other than those allowed by LAW.

In Writ Petition (MD) No. 34090 of 2025 Hon'ble Division Bench of the Madras High Court CLARIFIED and laid down the law regarding usage of the funds in the said Administration Fund.

It can be only for repaying the Government the sums paid by the Government under sub-section 4 of Section 92 of the TN HR&CE Act, 1959 - that is only for reimbursement of Department Expenses.

Government under Hon'ble @CMOTamilnadu should ensure all such misappropriation of the Administration Fund should be returned to the Fund.

Hon'ble @CMOTamilnadu and @RameshOffcl should announce in the Legislative Assembly that the Administration Fees charged on Temples will be reduced to 4% since Govt is charging 4 times more than the actual expenditure of the Department.

Besides the 3085 acres of 4 temples of Karur region - there are 500 acres of Sri Balasubramania Temple, Vennaimalai, Karur under chronic encroachment.

No action on these encroachments were taken by the AIADMK or DMK or TVK Governments as per Court orders dating 2019.

This is what the Hon'ble Judges - Justice Shri Velmurugan and Justice Shri Pugalendi said while hearing a contempt petition about the inaction of the Government

“The poor deity has no voting right. On the other hand, the mighty encroachers have valuable votes. In a democratic polity, electoral arithmetic sometimes appears to influence administrative resolve. But constitutional governance is not subordinate to electoral expediency,” the judges observed, adding that the deity, recognised as a juristic person in law, cannot be left remediless because it does not participate in elections. The deity may not vote, but the Constitution .

The judges also observed its not just poor people who are encroachers -

they noted " that among the encroachers, 27 are government officers, 49 are industrialists and 38 are people wielding considerable influence. This very composition explains why the eviction proceedings were thwarted through massive protests by political leaders irrespective of party lines".

The news that the death toll in the Ammonia gas tragedy in a pvt company in Thiruvallur has increased to 17 is deeply disturbing. All the deceased are women and were migrant guest workers from North India.

The TN government has given Compensation of Rs. 2 lakh to the next of kin of the deceased. How is this sufficient & justified? Odisha government has given Rs. 10 Lakh as compensation to the victim. The Odisha government also facilitated the return of those migrant guest workers who were discharged after the treatment. While the State Govt arranged safe passage of the deceased, how did the State administration forget the plight of those who were discharged from hospitals, waiting to return home?

The tragic loss of lives in the Ammonia gas tragedy in the private export firm in Thiruvallur also raises a lot of questions;

1)The first & foremost being the absence of the implementation of the 1979 Inter-State Migrant Workmen Act. Principal employers of establishments that employ five or more inter-state migrant workers must be registered under the Act. However, this accident and many earlier incidents have only shown that this Act is not implemented in Tamil Nadu and that no registry is being maintained.

Whenever a crime happens that involves a migrant guest worker from North India, a bunch of innocent migrant guest workers from North India are rounded up for enquiry, as there are no ways and means for the Police Department to narrow it down due to lack of registry.

However, after we pointed it out recently, we understand that the TVK Govt has begun enforcing this Act, at least in parts, if not in full. We trust that the State Govt takes the recent accidents/incidents seriously and enforces the availability of the register of migrant guest workers across all districts. TN State Govt could draw inspiration from the Athidhi app developed by Kerala for registering migrant guest workers and to ensure their welfare.

Even in the Thiruvallur ammonia gas tragedy, it was learnt that there was difficulty in establishing the actual identity of one of the deceased women, who carried a forged Aadhaar card to secure employment. This shows the inefficiency of the functioning of the inter-state migrant workers portal launched by TN Govt in 2023.

2)The welfare board for migrant guest workers is basically non-existent and needs to be established, strengthened and should be used to address the concerns of the migrant guest workers.

Tamil Nadu has today fallen below the replacement level, with a fertility rate of 1.3. To build the State’s infrastructure and work in industrial & commercial establishments across the State, we depend on the hard work of our migrant guest workers. Hence, it is important that we focus on their state of living, as most of the migrant guest workers are compelled to live in appalling conditions and have no place to complain, and their voices are never heard.

3)It is not just the duty of the welfare board but also the duty of the Department of Industrial Safety & Health (DISH) of the state government of Tamil Nadu. Even after a catastrophe that led to the death of 17 workers due to an ammonia gas leak, there seems to be no accountability taken by this department. It is time for “Transparency”. DISH should have made public their most recent inspection of this factory and any observations they made.

The factory in which these migrant guest workers suffered had accommodations within the place of work, surrounded by hazardous pipelines. How was this even allowed?

I demand that appropriate compensation be disbursed to the victims, that the 1979 Inter-State Migrant Workmen Act be enforced in both letter & spirit, and that transparency be brought by the Ministry of Labour of the TN State Govt on the functioning of the DISH & they also be made accountable, including the owners of the establishment, for deliberately ignoring the hazardous living conditions of the migrant guest workers.

What you see in this video is the blood stains of a young boy who was brutally murdered by a gang of five near the Meenakshi Amman temple in Madurai.

Drug peddlers, Sexual assaulters, and murderers have a free pass in Tamil Nadu. The State police seem to have learnt no lessons from the past, & the new TVK govt is yet to emerge from its celebratory mode and confront the grim realities unfolding on the ground.

இன்றுவரை இந்த வழக்கில் counter affidavit கூட தமிழக அரசாங்கம் தாக்கல் செய்யப்படவில்லை.

அதை @RameshOffcl என்ன ஏது என்று விசாரிப்பது அவருக்கு பல விஷயங்களை தெரியப்படுத்தும்.

இது போல பல வழக்குகள் இன்னமும் நிலுவையிலேயே உள்ளன.

முக்கியமாக இந்து சமய அறநிலையத் துறைக்கு கோவிலுக்குள் வேலையே இல்லை என்பதை அமைச்சர் @RameshOffcl தெரிந்து கொள்ள வேண்டும்.

சட்டப்படி நடப்பதாக பிரமாண பத்திரம் செய்துள்ளார். சட்டம் என்ன என்று தெரியவில்லை என்றால் அதன் படி எப்படி நடக்க முடியும்?!

ஒரு 4 நாட்கள் போதும். சொல்லி கொடுக்க நான் தயார்.

இப்பொழுதுதான் நிர்வாகத்தில் வந்துள்ளீர்கள். அவகாசம் கொடுக்க நான் தயார். ஆனால் படிக்க நீங்கள் தயாராக இருத்தல் வேண்டும்.

இந்த துறையில் இருக்கும் கூடுதல் ஆணையர்களை (additional commissioner) ஆய்வு செய்யுங்கள்.

அவர்கள்தான் எல்லா முறைகேடுகளுக்கும் காரணமானவர்கள்.

அதை விடுத்து கோவில்களில் அவர்கள் கீழே பணிபுரிபவர்களைக் கேட்டு பயனில்லை.

சொல்லப்போனால் ஒட்டுமொத்த தலைமை அலுவலகத்தில் இருப்பவர்களை வெளியேற்றாவிட்டால்சில நாட்களில் உங்கள் மீதும் பல புகார்கள் வரத்துவங்கும்.

அவர்களை வேறு துறைகளுக்கு இடமாற்றம் செய்து நல்லவர்களை துறைக்கு கொண்டு வாருங்கள்.

We, temple devotees, expect far bigger things from Shri @RameshOffcl - he should first go after the Elephants and not the mouses - in the corruption issues of @tnhrcedept
No. 01 - the Prasadam Stalls in Temples under licence from the Department are all frauds. The items sold there are not Prasadam. Only traditional food items prepared in a pious manner in the temple kitchen and offered to Bhagwan or Devi during poojas are Prasadam. Some possible quantity of it shd be distributed to devotees free of cost. Never sold.

Whenever Shri @RameshOffcl visits a temple officially, the he shd primarily focus on the following;
a. Violation of Court orders by @tnhrcedept officials.
b. He shd ask for a copy of legally valid order of appointment of Executive Officer. If there is no such order, he shd follow the directions of Hon’ble Division Bench given in Jan 2026 in Kallazhagar Temple case.
c. Pending audit objections for the temple
d. Property registers of the temple prepared under Sections 29, 30 and 31
e. List of major temple for which servants of @tnhrcedept have been appointed as Fit Persons
f. No renovation of temples without approvals from TN Heritage Commission
g. No compulsory collection from temples to Common Good Fund by the Commissioner or his subordinates
i. No utilisation of Common Good Fund by the Commissioner or his subordinates.
j. Full compliance of RTI Act, 2005 by the Department. He SHOULD FURTHER:
k. Take criminal action against the Commissioners in the past 15 years who approved misappropriation of temple funds for buying luxury cars, using temple funds for constructions improvements in HR&CE offices including construction of toilets, meeting halls, reception area and canteen.
l. Take action against the Commissioner who took ₹ 5.00 lakhs from Tiruttani temple to construct a library in the office of the Commissioner
m. Take action against the Commissioner who took ₹3.00 Crores for construction of municipal bus stand in Pazhani
n. Take action against the Commissioner who took ₹2 Crores from 5 different temples to construct Joint Commissioner’s office in Madurai
o. Take action against the Commissioner who misappropriated ₹15.00 lakhs funds of Sri Subramania Swamy Temple Tiruchendur for the purpose of computerisation of @tnhrcedept
p. Take criminal action against the Commissioner who misappropriated ₹1,79,11,555/- belonging to 24 temples for the purpose of computerisation of @tnhrcedept
q. Take criminal action against the Joint Commissioner, Thanjavur who misappropriated ₹9,95,366/- from the funds of Sri Mahamariamman temple, Valangaiman for the purposes of his office expenses
r.Take criminal action against the Commissioner, who misappropriated ₹1.9 Crores from the funds of 5 different temples to construct Regional Joint Commissioner’s office in Tiruchirapalli.
s. Take action for criminal dereliction of duties against the Commissioner and Tirunelveli Joint Commissioner for not paying rent to Sri Subramania Swamy Temple, Tiruchendur for 25 + years
t. .Take criminal action against the Commissioner, who misappropriated ₹1.1 Crores from the funds of 3 different temples to construct Regional Joint Commissioner’s office in Mayiladuthurai
u. Take criminal action against J Kumaragurubaran for giving approval to Madurai Temple Administration to buy a 3rd vehicle Innova Crysta at a cost of ₹30. 11 lakhs since according to him it is necessary for production of laddus, kum kum and to visit farms owned by the Temple.
v. Take criminal action against J Kumaragurubaran IAS for giving approval to Madurai Temple Administration to buy a 3rd car, Bolero vehicle since 2 Innova cars bought with temple funds were taken away by the Commissioner’s office.

The blatant call to eradicate #SanathanaDharma by Thiru.V.M.S.Mustafa, Tamil Nadu Muslim League founder and MLA of CM Vijay’s party -TVK is absolutely outrageous and highly condemnable.
