In recent days, concerns have been raised in Dhaka courts regarding the treatment of detained ministers, MPs, and leaders of the ousted Awami League government. These individuals, facing charges including murder, have been brought to court with their hands cuffed behind their backs.

The justification for this treatment, as stated by Public Prosecutor (PP) Advocate Omar Faruk Faruki, is to prevent them from chanting anti-government slogans. His remarks have drawn sharp criticism from human rights activists and lawyers, who argue that such reasoning is unacceptable and violates human rights.

Faruki defended the practice, stating that several detainees, including Salman F Rahman and Anisul Haque, had attempted to raise their hands and shout slogans when brought to court. He claimed that restraining them in this manner prevents disturbances and potential incidents. He also mentioned that detainees wear helmets with visors, further restricting their ability to vocalize opposition.

However, legal experts have condemned this approach. Supreme Court lawyer Manzil Morshed described it as a violation of human rights and judicial independence. He pointed out that the High Court has guidelines against handcuffing detainees unless they are extremely dangerous criminals. He also criticized the influence of certain lawyers who, in his view, undermine the judiciary’s independence.

Human rights activist Nur Khan also raised concerns, stating that security for detainees is crucial and that restricting their rights due to slogans is unjustifiable. He warned against creating an atmosphere of fear, likening it to past authoritarian practices.

Additionally, lawyers representing the detained politicians have faced physical attacks and threats. Advocate Morshed Hossain Shaheen, who is defending several former ministers and officials, has been assaulted multiple times. His chamber was attacked, and he now faces a murder attempt case along with 140 other lawyers. Despite these threats, he continues to handle the cases but remains in fear of further violence.

Attacks on lawyers have not been limited to political cases. A recent incident involved a defense lawyer in a rape case being assaulted by individuals demanding the death penalty for the accused. Lawyers have condemned such “mob justice,” emphasizing that legal representation is a fundamental right.

These developments highlight growing concerns over the rule of law and judicial independence in Bangladesh. Critics argue that silencing opposition voices and attacking defense lawyers undermine the justice system and human rights.

Awami League comments on UN Secretary General António Guterres’ visit to Bangladesh

UN Secretary-General António Guterres’ visit to Bangladesh this week is a critical reminder of the importance of protecting those persecuted because of their religion, ethnicity or political affiliation.

Yet, almost eight years since Sheikh Hasina’s Awami League government opened its doors to welcome over 700,000 Rohingya refugees fleeing brutal oppression in Myanmar, persecution persists in Bangladesh. This is not just against the Rohingyas – who have seen their food rations halved just this week by the UN’s World Food Program – but against Hindus, Christians, indigenous peoples living in the Chittagong Hill Tracts, women and girls, lawyers and journalists.

As the UN Secretary-General visits Bangladesh for the first time since the Interim Government assumed power, Mr Guterres must observe for himself the vital need for a further and truly impartial investigation into the oppression and disorder that has been allowed to take root under Dr Muhammad Yunus’ tenure since August 5.
In its recent report from the Office of the High Commissioner for Human Rights (OHCHR), the UN painted a one-side and incomplete picture of a country in turmoil. A country where revenge violence has been allowed to proliferate with total impunity, where victims of violent crimes are deprived of their right to seek justice, where religious and ethnic minorities live in fear, and where the principles of press freedom and fair trial have been eroded.

Bangladesh today has descended into lawlessness. Violence, disorder and state-tolerated destruction abound, while the authorities and security forces turn a blind eye, focusing instead on their ideological pursuit of any democratically dissenting voices they have characterised as ‘devils’.

The UN acknowledges for itself a critical flaw in the timeframe of its initial investigation, which is woefully confined to the events leading up to August 15. Today, the Awami League calls once again for a new and fully independent investigation of the violence, persecution and mob rule that have become established since August 5 to help address the urgent concerns of the Bangladeshi people, whose lives continue to be blighted by waves of crime.

Bangladesh cannot hope to return to its previously prosperous path and be considered a true multi-party democracy while its current government authorises the killing and unlawful detention of supporters of the Awami League and seeks to downplay the violent attacks that have targeted religious and ethnic minorities.

Mr Guterres must use this visit to hold the Yunus administration to account for the human rights abuses it has facilitated and ensure his offices conduct a fair examination of all the evidence before them, unclouded by partisan political beliefs. Accordingly, the Awami League also calls upon the Secretary General to establish a permanent OHCHR mission in Bangladesh, tasked with investigating present-day and ongoing abuses.

The Awami League is also deeply concerned by indications from the U.N World Food Programme that it intends to cut by more than half the value of food vouchers given to Rohingya refugees to just US$6 per person per month from April 1. Notwithstanding funding cuts to U.N budgets, this would be a completely unacceptable decision: a betrayal of some of the world’s neediest and most victimized people, and a betrayal too of Bangladesh’s persistent efforts to help them.

Mr Guterres must demonstrate good faith to Bangladesh. He must take the opportunity provided by his visit to Dhaka to reassure the country’s people that U.N. agencies will fight for their most urgent interests, and provide adequate resources to support the humanitarian needs of Rohingya refugees.

Mob Pressure vs. Rule of Law: A Dangerous Precedent ...

A judge grants bail. A mob surrounds the police station. Outrage erupts—was the decision a product of legal obligation or intimidation❓

Under the law, bail must be granted unless the accused is a flight risk, a threat to public safety, or likely to tamper with evidence. If none of these conditions applied, denying bail would have been judicial overreach—an abuse of power. Yet, the perception that mob coercion influenced the ruling raises two grave dangers for Bangladesh’s justice system:

1️⃣ When courts yield to mob intimidation, justice is dictated by force, not law. Today it’s bail, tomorrow it could be verdicts. When the loudest voices dictate justice, the judiciary collapses.

2️⃣ When courts deny bail just to pacify public anger, the state’s power to arbitrarily imprison people strengthens. Justice becomes performative—an illusion meant to satisfy outrage rather than uphold rights.

This isn’t just about one case—it’s about the future of Bangladesh’s legal system. If mobs can override due process, what’s next❓How long before courts cease to function as independent institutions?❓

The real question isn’t whether the judge should have granted bail—the question is whether Bangladesh will uphold the rule of law or surrender to the tyranny of the streets.

While preventing human rights abuses is a legitimate concern, the UN’s own General Assembly Resolution 48/141 clearly states that the OHCHR must respect national sovereignty and domestic jurisdiction.

The OHCHR’s involvement in Bangladesh reflects a broader pattern of UN overreach, where the office acts without explicit invitations from the concerned state. Under its mandate, the OHCHR may only provide advisory services “at the request of the State concerned.” Acting without such a request contradicts established UN principles and sets a worrying precedent.

UN Human Rights Body Became Democrats Tool for Regime Change

UN High Commissioner for Human Rights, Volker Türk, openly admitted that he personally warned (or rather, threatened) the Bangladesh Military—with UN peacekeeping mission—not to assist the government in handling the chaos and violence in July. In his own words, "he warned them not to get involved with the situation.” This interference came at a critical moment when the government imposed a curfew on July 18 to restore law and order. As a result, the civil administration was left to tackle the mayhem, riot, chaos and instability all alone, without military support. The primary responsibility of any armed force is to assist the government in maintaining peace and stability when the situation spirals out of control.

Yet, Türk’s warning actively discouraged that duty. It is also important to note that most of the casualties occurred between July 19 and July 24. Had the military been allowed to act, could many of these deaths have been prevented. Türk’s statement makes it clear: The UNHCR was not a neutral body in this crisis. By instigating the army to defy its own government, the UNHCR became a complicit actor in the events that led to these casualties.

On August 6, Dhaka police claimed to have foiled the pre-announced "March for #Caliphate" by internationally recognized militant outfit #HizbutTahrir, set for March 7. Yet, the banned jihadist group freely gathered and marched in the capital, openly demanding an end to democracy and waging a crusade against the West.

This blatant display of extremism, under the nose of law enforcement, is a chilling testament to the @ChiefAdviserGoB regime’s silent patronage of radical outfits. The so-called police action was nothing but a smokescreen, as jihadist networks thrive under state negligence.

Scenes from banned #Islamist group #HizbutTahrir's showdown in #Dhaka today: "March for #Caliphate".

Defying administration's orders, banned Islamist group Hibut Tahrir, which has the objective of forming a global #IslamicState or Khilafat, today took out their "March for Khilafat" in downtown Dhaka.

The march, attended by thousands of the group's followers, led to a clash with the police following Jummah prayers. The rally began from the north gate of Baitul Mukarram Nat'l Mosque. The procession initially proceeded without disruption, but tensions flared as demonstrators moved from Paltan towards Bijoynagar, where police set up a blockade.

For the last 7 months, the Interim Govt of Dr. #Yunus has allowed these groups to grow in strength and numbers. #Hizbut even did open recruitment drives in various areas of Dhaka right under the noses of law enforcement agents. Today's showdown was a direct consequence of the Interim Govt's extremely accommodating policy towards such groups and Islamists generally.

Now the chickens have come home to roost.

A single incident ties in multiple aspects of what's wrong with #Bangladesh at the moment: Encroachment on #women's hard earned freedoms, #Islamist resurgence and influence, a violent #mob-culture, and an intimidated #justice system.

This is what happened:

A man named Mostafa Asif Arnob harassed a female student of #Dhaka University in her own campus yesterday claiming that she was "not wearing her scarf properly".

The girl posted about the incident on social media, which helped others identify the harasser as a staff of the university's library. Based on an official complaint, he was arrested and taken to the local police station (Image 1). News🔽

#Islamists under the banner of "Tawhidi Janata", in support of the harasser's attempts at moral policing of women, besieged the local police station for 8 hrs and demanded his release (Image 2). News🔽

In the morning, the harasser was produced before a magistrate, during which time, the Islamists followed him and took position in the court premises. News🔽

In court, as expected, Arnob was granted bail. This is despite the fact that even detained journalists like Farzana Rupa and Shakil Ahmed haven't made bail six and a months after their arrests. It is very likely that the court itself was under pressure of the Islamists to release their ideological brother. After his release, the Islamists received the harasser as a hero (Image 3). News🔽

#NCP’s chief organiser (northern region) #SarjisAlam said today:

“Nobody should speak about elections even mistakenly until we see killer Hasina hanged.”

The above comment by Sarjis Alam needs to be assessed in light of the NCP's broader demands for a constituent assembly, a new constitution, and a "second republic".

This is significant for two distinct reasons:

First, as feared, the NCP will not, using its massive influence on the Yunus Govt, allow nat'l #elections to take place by December 2025 as announced by the Chief Adviser and the Election Commission. Whether tying elections to ICT-BD verdicts, or demanding elections to a constituent assembly, they will use whatever excuse they can to delay elections indefinitely.

Second, the NCP has already decided that #SheikhHasina will be "hanged". There is no issue of the Int'l Crimes Tribunal (ICT-BD) finding her guilty, that is already determined. Such remarks from a party with direct representation in the Interim Govt is tantamount to gross executive interference in the workings of the judiciary.
